The Board of Supervisors APPROVES Addenda 1 through 5 to the bid documents for
Superior Court Annex, 1020 Ward Street, Martinez. These Addenda add an alternate bid
item for drilled foundation piers to the bidding requirements and provide for moving
the building five feet in a southerly direction, as required by the Board on April 8,
1986. Also, these Addenda provide miscellaneous changes and clarification to the
contract- documents and extend the bid opening date from May 8, 1986 to May 19, 1986,
to provide ample time for bidders to prepare bids and to provide additional time for
publication of an advertisement for bids in accordance with the Public Contract Code. '

SUBJECT: OFFICE FACILITY ON DELTA FAIR BOULEVARD NEAR BELLE DRIVE, ANTIOCH,CALIFORNIA
(WPE245); Finding of a Public Necessity and Approving Addenda 1 and 2.
Specific Requests or Recommendations & Background & Justification
I. RECOMMENDATION
A. Find that a public necessity exists which will permit the prime bidders for the
Office Facility on Delta Fair Boulevard near Belle Drive, Antioch, to omit the
list of subcontractors in the original bid, pursuant to Government Code Section
4109.
B. Approve Addendum No. 1 and Addendum No. 2 to the bid documents for the Office
Facility, in which various clarifications and changes are given and the requirement
.to list subcontractors in the original bid is changed to require subcontractor
lists after the Contractor's construction documents are approved.
II. FINANCIAL IMPACT
If these recommendations are approved, the financial impact will be a reduction in the
cost of the project to the County. The amount of such reduction is difficult to
predict or measure, but it would be significant.
III. REASONS FOR RECOMMENDATIONS/BACKGROUND
A. The finding of public necessity is being recommended because compliance with
Government Code 4104, which requires listing of subcontractors by original
bidders, would cause the County substantial expense and would be unavailing.
Such listing would be unavailing because bid documents for this project are not
sufficiently complete to obtain precise sub bids: The bid documents do not
include complete construction documents; they include only schematic design
drawings and specifications, which the successful bidder must expand and complete
before it can construct the office facility.
B. This approach to the bid documents was necessary because the option to purchase
the project site expires on June 30, 1986; certificates of participation must be
sold to fund the site acquisition; and construction bids must be in hand before
certificates can be sold. Complete construction documents could not be provided
in time to meet the June 30 deadline, consequently bids are being solicited with
schematic design documents , not complete construction documents. Since complete
construction documents are not available to bidders, it is impractical and
expensive for bidders to obtain firm sub bids and list subcontractors.
