SUBJECT: Legislation: Senate Bill 2363
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AMID JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for SB 2363 by Senator Bergeson if
the bill is amended to add Contra Costa to its provisions.
BACKGROUND:
Existing law authorizes certain counties to establish a
Courthouse Temporary Construction Fund to be funded by a penalty
assessment of $1. 00 for every $10. 00 collected on non-parking
offenses to be used for the rehabilitation, construction, and
financing of courthouses. Existing law also authorizes certain
counties to establish a county Criminal Justice Facility
Temporary Construction Fund to be funded by penalty assessments
of $1 . 00 for every $10. 00 collected on non-parking offenses, and
a surcharge of $1 . 50 on each parking fine or forfeiture
collected, with $1 .00 for each parking case filed to be deposited
in the fund to be used for the construction of county criminal
justice facilities.
Senator Bergeson has introduced SB 2363 for Orange County. The
bill would authorize Orange County to increase the penalty
assessment collected for the county Courthouse Temporary
Construction Fund and the county Criminal Justice Facility
Temporary Construction. Fund from $1. 00 to $2 . 00 for every $10 . 00
collected for non-parking offenses, and to impose a $1 . 50
surcharge on fines and forfeitures collected for parking
offenses, and to require $1. 50 for each parking case filed to be
deposited in these funds.
The Clerk-Administrator of the Walnut Creek-Danville Municipal
Court estimates that if these provisions introduced for Orange
County were applied in Contra Costa County, the revenue to the
Temporary Courthouse and Criminal Justice Facility funds would be
increased by approximately $1.1 million a year.
Preliminary discussions with staff from the Orange County
Administrator' s Office indicates they may not be opposed to
amending the bill to add Contra Costa County to the provisions
outlined above for Orange County. We are currently discussing

with our lobbyist and the lobbyist from Orange County the
feasibility of recommending such amendments. Because of the
substantial revenue which would be produced, and the pressing
need for construction and renovation of courthouse and jail
facilities in this County, we believe that adding Contra Costa
County to SB 2363 should be requested by the Board, and that the
bill once so amended deserves the Board' s support.
