Adopt a position supporting SB 2165 by Senator Mello.
BACKGROUND:
Existing law provides that specified fees for reporting and
transcription ordered by the court in a criminal case shall be
paid out of the county treasury. Senator Mello has introduced SB
2165 at the request of Monterey County. This bill would require
the State Controller to reimburse the county for all fees and
expenses incurred by a county in preparing a transcript on an
appeal and the fees paid by the County for a reporter' s
transcript in criminal cases in which a defendant appeals any
court order or judgment of the Superior Court. The bill
currently proposes to appropriate an unspecified amount to
reimburse counties for these costs.
The Superior Court Administrator recommends that the Board
support SB 2165 on the basis that the transcripts prepared for
the Appellate courts are for the benefit of the Appellate courts
and should, therefore, be a State expense. The Presiding Judge
of the Superior Court concurs in this recommendation.
In this County, the cost of these transcripts is estimated to be
approximately $200,000 a year. On this basis, this office also
concurs with the Superior Court Administrator that the Board
should support SB 2165.
