April 30, 1986 Courty SUBJECT: Legislation: Senate Bill 1641 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for SB 1641 by Senator Stiern. BACKGROUND: Existing law provides that a public agency, or public safety employee, is not liable for an injury caused when such an employee is acting within the scope of his or her employment to abate or attempt to !abate hazards caused by the discharge, spill, or presence of a hazardous substance unless the action taken was performed in bad faith or in a grossly negligent manner. Senator Stiern has introduced SB 1641 which would extend this immunity to registered Sanitarians who are employees of a State or local agency and county Public Health Directors. The inclusion of registered Sanitarians and Public Health Directors is limited to situations in which the employee, at the request of the police or fire agency in charge of scene management, provides emergency assistance or advice. The bill also requires that the request issued by the scene manager shall be confirmed in writing in the form of a report on the incident. The Health Services Director recommends support of SB 1641 because . of the increasing involvement of the County' s Environmental Health staff and Health Officer in responding to hazardous material spills. Our office concurs in this recommendation.
