(Correcting Clerical Error in Smoking Ordinance)

The Contra Costa County Board of Supervisors ordains as
follows (omitting the parenthetical footnotes from the
official text of the enacted or amended provisions of the
County Ordinance Code) :

SECTION I: SUMMARY. This ordinance amends Section 9 of
County Ordinance Number 85-57 to insert language relating to
the penalties for violations of Ordinance No. 85-57 which
was inadvertently omitted when the ordinance was adopted.
SECTION II: Section 9 of Ordinance Number 85-57 is amended
to read:

SECTION 9. Penalties.
A. it is unlawful for any person who owns, manag-
es, operates, or otherwise controls the use of any
premises ' subject to the restrictions of this ordinance
to fail to: properly post signs required hereunder; to
provide signs for the use of employees in designating
their areas; to set aside "No Smoking" areas; to adopt
a smoking restriction policy; or to comply with any
other requirements of this ordinance.
B. It shall be unlawful for any person to smoke in
any area' restricted by the provisions of this ordi-
nance.
C. Any person or business who violates Subsection
A or B herein, or any other provisions of this ordi-
nance, shall be guilty of of an infraction, punishable
by:
(1) A fine, not exceeding $100, for the first
violation;
( 2) A fine, not exceeding $200, for a second
violation of this ordinance within 1 year;
( 3 ) A fine, not exceeding $500, for each addition-
al violation of this ordinance within 1 year.
SECTION III: ; EFFECTIVE DATE. This ordinance becomes effec-
tive 30 daysiafter passage, and within 15 days of passage
shall be published once with the names of the supervisors
voting for and against it in the ."artinez clews Gazette
a newspaper published in this County.

AN ORDINANCE AUTHORIZING THE ACT OF EXECUTING A FACILITY
LEASE OF PROPERT LOCATED AT 1020 WARD STREET, MARTINEZ,
CALIFORNIA

WHEREAS, the County of Contra Costa (the "County" )
intends to advertise for bids on the lease by the County of
certain real property located at 1020 Ward Street, Martinez,
California, on the conditions, among others, that the
accepted bidder shall be required to (a) enter into a
contract to construct on said property a building commonly
known and designated as the Superior Court Annex and to
contain approximately 51,000 square feet, together with site
development, landscaping, utilities, equipment, funishings,
improvements and appurtenant and related facilities (herein
called "Capital; Project IV" ) , and (b) lease said property

back to the County, under a Facility Lease; and
WHEREAS, the County now has a need for and desires
to obtain the use of Capital Project IV and the County
proposes to lease said property from the successful lease
I
bidder; and

WHEREAS, the Contra Costa County Public Facilities
Corporation (herein called the "Corporation") is a nonprofit
corporation formed to render financial assistance to the
County by financing the acquisition, construction,
improvement and remodeling of public buildings and facilities
for the County; and
WHEREAS, the County now has a need for and desires
to obtain the use of an office building in the City of
Antioch, Califolnia, commonly known and designated as the

East County Social Services Building, to be located on Delta

Fair Boulevard near Belle Drive and to contain approximately
52, 650 square feet, together with parking, site development,
landscaping, utilities, equipment, furnishings, improvements
and appurtenant and related facilities (herein called
"Capital Project V" ) , and the County proposes to lease
Capital ProjectlV from the Corporation;
NOW, THEREFORE, the Board of Supervisors of the
County of Contra Costa does ordain as follows:
1. It is hereby found and determined that it is
in the public interest, convenience and welfare and for the
common benefit -of the inhabitants of the County that the
County lease Capital Project IV and the site thereof from the
successful bidder.
2. The act of entering into a lease of Capital
Project IV by the County from the successful bidder be and it
is hereby approved. The form of proposed Facility Lease

(Capital Project IV) between the successful bidder and the
County, submitted to this Board of Supervisors and on file in
the office of the Clerk of the Board of Supervisors of the
County and to which reference is hereby made, and the terms
and conditions thereof, are hereby approved. Upon
determination of the base rental to be paid under
section 3(a) thereof by resolution of this Board of
Supervisors, the Chairperson of this Board and the Clerk of
this Board are authorized and directed to execute and deliver
said Facility Lease in substantially said form, as completed
to include such subsequently determined base rental;
provided, however, that the amount of such subsequently
determined base rental payable in any twelve-month period
shall not exceed $1, 750, 000.
3 . The Chairperson of the Board of Supervisors
and the Clerk of the Board of Supervisors are authorized to
make such changes to the Facility Lease prior to the
execution thereof as may be required in the interest of the
County where such changes do not materially increase the
obligation of the County or where such changes are first
approved by resolution of this Board of Supervisors.
4. If the Corporation is the successful lease
bidder for the lease and leaseback of Capital Project IV,
this Board of Supervisors reserves the right to combine the
facility leases of Capital Project IV and Capital Project V
in one lease, and in such event, the amount of base rental

payable in any twelve-month period for the combined lease
shall not exceed $3,000,000.
5. This ordinance shall take effect and be in
force thirty days1 lfrom and after the date of its adoption.
Pursuant to Section 54242 of the California Government Code,
this ordinance islsubject to the provisions for referendum
applicable to ordinances of the County as such provisions are
set forth in Sections 3750 through 3756 of the California
Elections Code.
6. This ordinance shall be published after
adoption as required by law.
