SUBJECT: MISCELLANEOUS EXTERIOR REPAIRS AT COURTHOUSE, 725 COURT STREET, MARTINEZ

Specific Requests or Recommendation(s) & Bac group ustification
I. RECOMMENDATION
Approve an increase of $4,428 in the authorized expenditure limit previously authorized
for emergency repairs to the exterior surfaces of the Courthouse, pursuant to Section
20134 of the Public Contract Code, to cover the extended scaffold rental costs caused
by delays due to inclement weather.
II. FINANCIAL IMPACT
Costs will be paid with funds from existing plant acquisition accounts. Funds will be
obtained by canceling other projects or by transferring funds from other projects.
III. BACKGROUND
A. On October 8, 1985, the Board found that an emergency existed and authorized
repair of deteriorated roof cornice gutters and loose ornamental terra cotta and
concrete elements which were discovered during performance of a contract for
stripping and cleaning the exterior surfaces of the Courthouse.
B. On November 5, 1985, the Board found that an additional emergency existed and
authorized repair of the deteriorated, loose plaster veneer over the Court Street
Colonnade and the patching, sealing and waterproofing of the upper surface of the
exterior walls.
C. The unusually wet, cold weather which occurred during the winter months caused
unforeseen delays in the completion of the work, which increased the scaffold
rental costs beyond those originally expected.
D. Since it was economically undesirable to remove the scaffolding prior to completing
all of the work, the scaffolding was left in place and the rental costs were
continued. The Contractor has been charged for the increased rental costs and is
entitled to be reimbursed.
IV. CONSEQUENCES OF NEGATIVE ACTION
If the recommended increase in expenditure is not approved, the Contractor may file
suit to recover these added rental costs due to unforeseeable causes beyond the
control and without the fault or negligence of the Contractor.
