Smith (Martinez TaxiCab Company) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the Chairman to execute on behalf of the County, Contract Amendment Agreement #26-053-9 with Floyd L. Smith (dba Martinez TaxiCab _Company) effective January 1, 1986 to amend Contract 426-053-7 (effective July 1, 1985 - June 30, 1986) for provision of taxi transportation for County Hospital patients with a $25,000 increase in the contract payment limit (from $25,945 to a, new total payment limit of $50,945) . II. FINANCIAL IMPACT: Funding for this service is included in the FY 1985-86 Enterprise I Budget . Actual cost to County depends upon utilization. As appropriate, patients and third-party payors will be billed for service. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: Since 1980 the County has contracted with Floyd Smith (Martinez TaxiCab Company) for transportation services . On June 26, .1984 the Board approved Contract 426-053-6 with Floyd Smith (dba Martinez TaxiCab Company) for taxi transportation for County Hospital patients. Contract 426-053-6 did not contain a contract payment limit. Payment was based on a fee of $1.30 per mile regardless of the number of patients transported to a single destination at one time in the "same taxi. On June 4, 1985, the Board approved Contract 426-053-7 with a payment limit of $25,945 to continue this service through June 30, 1986 at the same $1.30 per mile rate, and on April 26, 1986 approved Contract Amendment Agreement 426-053-8 to increase the contract payment limit, effective April 15, 1986, from $25,945 to a new total payment limit of $50,945. Subsequently, it was discovered that on January 1, 1986 the payment demands for taxicab services exceeded. the contract payment limit, and the Auditor-Controller was unable to pay the Contractor for services rendered between January 1, 1986 and April 15, 1986, the effective date of Contract Amendment Agreement 426-053-8. Taxicab services were both requested by County staff and provided by Floyd Smith (Martinez TaxiCab Company) in good faith, and Mr. Smith is continuing to provide services under the terms of the contract as amended by Contract Amendment Agreement 426-053-8. Because of administrative oversight by both the County and Mr. Smith, use of the taxicab service exceeded the authorized payment limit during the period January 1, 1986 through April 14, 1986. The Health Services Department is requesting approval of Contract Amendment Agreement 426-053-9 which will cancel the prior amendment and replace it effective January 1, 1986 so the contractor can be paid for the services requested by the Department and provided by contractor since January 1, 1986.
