May 14, 1986 l./<Xi* SUBJECT:Legislation: East Bay Regional Park District SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Agree not to oppose legislation sponsored by the East Bay Regional Park District which would provide for the transfer of 50% of all fines and forfeitures collected for conviction of any person, or upon the forfeiture of bail from any person arrested for a violation of any rule, regulation, or ordinance of a recreation and park district committed on property policed by the district, with the remaining 50% to be retained by the County. BACKGROUND: Under current law, 500 of the fines and forfeitures for violations occurring on property owned, administered, or controlled by a recreation and park district is transferred to the district, with the county retaining the balance. The East Bay Regional Park District (EBRPD) has a contract under which they police certain lands belonging to the East Bay Municipal Utility District. Currently, EBRPD does all the policing work while the County retains all the revenue. The County incurs costs for all the related court work. However, it appears only reasonable to share the fine and forfeiture revenue with EBRPD. David Pesonen, General Manager of EBRPD, has asked the County to agree not to oppose this legislation. The legislation would expand Penal Code Section 1463 . 05 to include in the 50% split to the EBRPD land "policed" by the district. The total fines and forfeitures covered by this amendment are estimated to be approximately $50,000 per year, meaning a loss to the County of approximately $25,000 per year. We believe that if the District knows they will retain 50% of the revenue from EBMUD land, they may be more diligent in citing violators of various offenses thereby increasing overall revenue and improving the level of police protection on EBMUD property within the County that is policed by EBRPD staff.
