HomeMy WebLinkAboutMINUTES - 05201986 - 1.17 � t7 ORDINANCE NO. 86-39 (County Road Fee Procedures) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance ,Code) SECTION I . SUMMARY. This ordinance revises County Ordinance Code Division 913 on Bridge Crossings and Major Thoroughfares to specify current requirements . SECTION II . Section 913-2 . 418 of the County Ordinance Code is amended, to provide for community development director administration, to read: 913-2 . 418 Public works director. "Public works director" means the county' s directors of public works or community develop- ment and includes their duly authorized subordinates . (Ords . 86-39 92, 79-80; see § 24-22 . 006 . ) SECTION III . Section 913-6 . 004 of the County Ordinance Code is amended, to specify current report requirements, to read: 913-6 . 004 Contents . The report shall contain information and data related to the boundaries of the area of benefit, the estimated costs of the proposed improvement, the method(s) of fee apportionment, and the anticipated revenue source (s) , including any general fund revenues . It must be based on a development program for the area adopted by the board. (Ords. 86-3g §3, 79-85 §2, 79-80: Govt .C. §65962 . ) SECTION IV. Section 913-6 .014 of the Ordinance Code is amended, to specify current notice requirements,' to read: 913-6 . 014 Notice of hearing . The public works director shall give notice of the hearing, in accordance with the provisions of Government Code Section 65091, and the notice shall include the information specified in Government Code Section 66484 (2) . (Ords . 86-39§4 , 79-80 . ) SECTION V. Section 913-6 . 024 of the Ordinance Code is amended, to provide ordinance adoption, to read: 913-6 . 024 Hearing. The board shall hear the matter as scheduled, or as postponed or continued for good cause , and consider any objections or protests . At such hearing, the board may then adopt, revise, reduce or increase any portion of the report. The board, by ordinance, shall establish the boundaries of the area of benefit, the costs, whether actual or estimated, and a fair method of allocation of costs to the area of benefit and fee apportionment; and the board must find that the road and/or bridge improvements are necessary and desirable within the area of benefit. (Ords . 86-39 §5, 79-85 §3, 79-80 : Govt.C. §65962 . ) SECTION VI . Section 913-6 . 026 of the County Ordinance Code is amended, to provide ordinance recordation, to read: 913-6 . 026 Recording. The clerk of the board shall promptly file a certified copy of this ordinance with the county recorder . (Ords . 86-39 §6, 79-80 : Govt .C . §65962 . ) SECTION VII . EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days of passage shall be published once with the names of the supervisors voting for and against it in the Contra Costa Times a newspaper published in this County.
