Contra `I a Supervisor Tom Torlakson DATE Costa ; COO^ May 13 , 1986 SUBJECT: HIGHWAY 4, WILLOW PASS GRADE PROJECT: ADDITIONAL WEST-BOUND LANE SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Approve in concept a financial commitment for funding the $2 million lane addition to Highway 4 over the Willow Pass grade and ask the County Administrator, County Counsel, Public Works and the Community Development Department to prepare the necessary resolution and proposal alternatives for implementing a funding mechanism. While, by the action, agreeing to the concept of the county repaying its fair share of the $2 million loan, the Board will make a final determination as to the exact repayment method when the altrnatives report is brought back to the Board of Supervisors. (NOTE: The concept of a "Highway 4 Fund" was previously referred to staff on April 1, 1986 (copy attached) . Steve Goetz of the Community Development has nearly completed the research in this matter and would be ready to report to the Board next week. ) BACKGROUND INFORMATION: Scheduled this evening for a second discussion and action by the Antioch City Council is a proposal to finance the proposed $2 million lane addition to Highway 4 in the west bound direction over the Willow Pass grade. This Board previously supported the allocation of Seed money to begin the engineering work--our share to be $25,000, the balance of $75,000 to be committed by the other jurisdictions (Antioch, Pittsburg and Brentwood) . The action sought by the Board today takes the concept one step further and would enable more rapid movement in the process of obtaining the funding for the road improvement. Mayor Joel Keller of the City of Antioch worked with the ABAG staff on a , proposal for a $2 million "certificates of participation" issue which can be done independently in the next several weeks if there is a commitment by the cities and the county to back up this measure. I have proposed that the basis for repayment of the $2 million plus interest shall be determined by examining the number of building permits let during each year for a five yar period. The basis by which the "loan" would be repaid would be by apportioning a share the annual bill according to a jurisdiction' s share of the of total building permits let out in East County (unincorporated areas--West Pittsburg, Oakley, Bethel Island, Byron, Discovery Bay, Knighten--and the cities of Antioch, Pittsburg and Brentwood) . Each jurisdiction would then have a choice as to how it would pay its share. It is likely that most jurisdictions will opt for a builder fee to accomplish this. Other choices include the use of General Fund money or redevelopment area money. The City of Antioch will be moving toward a building fee and I concur with this for the unincorporated area. My calculations estimate the fee would be between $100 to $300 per Q/house. This matter will be brought before the Pittsburg City Council the following Monday and before Brentwood in the very near future. The faster we act, the sooner this project can begin. Antioch would like commitment from the county to this proposal and they will then be able to provide the additional $75 ,000 for the engineer- ing so that work can commence. The County Transportation Advisory Committee (CTAC) received a report from Maurice Shiu on the west bound lane addition last week and from Steve Geotz on the funding mechanisms. A motion was made and passed by CTAC approving proposal for the westbound lane addition and the concept of the east county jurisdictions moving ahead to develop a financial plan to address this issue. BOARD OF SUPERVISORS (` FROM: Supervisor Tom Torlakson Contra Costa DATE: April 1, 1986 County SUBJECT: ESTABLISHMENT OF HIGHWAY 4 FUND AND DEVELOPMENT FEE SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Refer to the Community Development Department and Public Works Department to: ( 1) develop the concept of a Highway 4 fund and the establishment of a fee of at least $100 per new housing unit; ( 2) develop a strategy for implementation of such a fee that could go toward Highway 4 projects (e.g. , the widening and lowering -of the Willow Pass Grade, the $80 million (check) to add two lands between Willow Pass and Antioch, and far east county Highway 4 projects) ; ( 3 ) communicate with the Building Industries Association and builders. in the east county area to discuss this concept and the need for addressing the Highway 4 crisis; and ( 4) communicate with the cities of Antioch, Brentwood and Pittsburg regarding this concept and explore how this concept might be cooperatively implemented among all east county jurisdictions. BACKGROUND INFORMATION: CalTrans and the federal government appear to have no money in the immediate future to address the transportation crisis on Highway 4. The Highway 4 fee would begin a "revenue stream" from which money could be borrowed to do the interim lane widening and to help with the necessary local match for the ultimate widening. As l indicated in a letter to the Eastern Contra Costa Transit Autho- rity which I presented to the` Board last week, the prospects for a near-term fiscal solution to the Willow• Pass Grade project are also threatened by the federal retreat from support for transportation and by the unwillingness of the current governor to support a gas tax increase and a bridge toll increase which could bring in the necessary revenues to address our funding problem. Under any scenario, however, it is clear that more local share dollars will be demanded to leverage what state and federal transportation dollars are available. Itis for these reasons that I have initiated the establishment of a Regional Traffic Mitigation Fund. Our efforts alone in the unincorporated area should yield at least $3 million in the next ten to fifteen years. I have for some time believed that we should apply a fee of at least $100 for every new home constructed in East Contra Costa County to put into a "Highway 4 Fund" to address the Willow Pass Grade Project and the con- struction of extra lanes through Pittsburg and Antioch. There are parts. of Highway 4 going through far east county that also need local matching funds for improvements. If the 40,000 housing units currently planned in all East County jurisdictions over the next fifteen to twenty years are con- structed,' a $100 fee would produce $4 million. il One immediate significance of implementing the $100 Highway 4 fee for East County is that it would identify a "revenue stream" beyond what the county is conditioning in central county office parks. This "revenue stream, " ,,I believe, could be used as the basis for borrowing $1 million from this county' s Federal Aid Urban Fund and would be the source of the loan repayment. TT:gro i
