NOES: None. ABSENT: Supervisor Schroder . ABSTAIN: None.. SUBJECT: Determination of Property Tax) Transfer for the Dissolution ) of County Service Areas R-6 ) RESOLUTION NO. 86/ 269 and P-4 (LAFC 85-36 & 85-37 ) Respectively) ) WHEREAS, the Board of Supervisors of Contra Costa County has initiated proceedings for the dissolution of County Service Areas R-6 and P-4 (CSA' S R-6 and P-4) ; and WHEREAS, Section 99 of the Revenue and Taxation Code provides that a jurisdictional change affecting one or more special districts shall not become effective until the Board of Supervisors agrees by resolution to an exchange of property tax revenues among affected agencies; and WHEREAS, Contra Costa County on behalf of the two county service areas is the only agency affected by the subject reorganization; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE that 100 percent of the property tax accruing to CSA' s R-6 and P-4 from the affected territory of the proposed dissolution shall be transferred to the County General Fund for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. The terms of the property tax transfer shall apply in subsequent years unless changed by the mutual agreement of the affected agencies or subsequent jurisdictional changes. This resolution does not change the property tax revenue accruing to other agencies servicing the subject territory or the affected agencies' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission. SUBJECT: Determination of Property Tax ) Transfer for the Consolidation ) of All "L" Street Lighting ) RESOLUTION NO. 86/ 268 County Service Areas - L-32, ) L-421 L-43 and L-46 (LAFC 86-10) WHEREAS, the Board of Supervisors of Contra Costa County has initiated proceedings for the consolidation of County Service Areas L-32, L-42, L-43 and L-46; and WHEREAS, Section 99 of the Revenue and Taxation Code provides that a jurisdictional change affecting one or more special districts shall not become effective until the Board of Supervisors agrees by resolution to an exchange of property tax revenues among affected agencies; and WHEREAS, Contra Costa County on behalf of the four lighting districts is the only agency affected by the subject reorganization; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE that 10.0 percent of the property tax accruing to County Service Areas L-32, L-42, L-43 and L-46 from the affected territory of the proposed consolidation shall be transferred to the new consolidated district for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. The terms of the property tax transfer shall apply in subsequent years unless changed by the mutual agreement of the affected agencies or subsequent jurisdictional changes. This resolution does. not change the property tax revenues accruing to other agencies servicing the subject territory or the affected agencies ' right to collect taxes for existing bonded indebtedness.
