BACKGROUND: Current law which requires that every motorist carry proof of insurance also contains provisions to: ( 1) Require the court to spinoff from gross collections $10 for each violation of this requirement which is filed with the court for deposit in a special county fund to defray court administration costs. AB 4008 would instead require the court to spinoff from gross collections $10 for each violation of this requirement only when a fine is collected. ( 2) Require the court to spinoff from gross collections $3 for each conviction of this requirement for deposit in the State' s transportation fund. AB 4008 would instead provide that the $3 transfer to the State would occur only on each fine collected. ( 3 Require the court to spinoff from gross collections $10 for each violation of this requirement filed with the court for deposit in the State' s General Fund. AB 4008 would require that the $10 transfer to the State General Fund occur only on each fine collected. The impact of the change in ( 1) would be to substantially reduce the revenue credited to the special fund for court administration costs. Most of these citations are dismissed when the motorist provides proof of insurance. Court staff must review insurance documents and verify that the insurance is in force, thereby increasing clerical time. The $10 spinoff should apply, therefore, on all cases filed. The impact of the changes in ( 2) and ( 3 ) are beneficial to the County in principle, but also involve ' the more complex administrative procedure of having to make the credit on each fine paid rather than each conviction. The Board is already in support of SB 1592 which would change ( 3 ) to provide that the credit to the State General Fund would only occur on convictions rather than all filings. SB 1592, therefore, will resolve the problem with ( 3 ) and since ( 2 ) already applies only to convictions, it is administratively simpler than going to fines paid. Because of the loss in revenue and administrative complexity involved in AB 4008, it is recommended that the Board of Supervisors oppose AB 4008.
