SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Authorize the Director of Personnel to sign the attached letter (Exhibit A) to Shell
Oil Company regarding payment of $15,924.02 from Shell for the reimbursement of costs
incurred by the County as the result of the accidental release of Hydrogen Sulfide and
Sulfur Dioxide gases .
BACKGROUND
Several air emission incidents have occurred at the Shell Refinery that have resulted
in costs to the County. These primarily include costs for lost production time and an
alarm system and wind socks installed at the Shell Avenue Corporation Yard. Shell has
agreed to reimburse the County for these costs and has requested a letter which indicates
that the above payment will cover all costs associated with the emissions which occurred
on August 29, 1985 and September 6, 1985.

Dear Mr. Planzo:
Reference is made to your conversation with Bill Ray of my staff concerning the
reimbursement for costs incurred by the County resulting from air emissions at
the Shell Manufacturing Complex.
It is my understanding that Shell has agreed to reimburse the County for
$15,924.02 for the charges enumerated in the enclosed attachment.
Payment will cover all costs for evacuating the Corporation Yard located on Shell
Avenue and for other County costs associated with the emissions which occurred
on August 29, 1985 and September 6, 1985. As Mr. Ray previously indicated, the
above payment is for the costs incurred by the County and not for those that
employees may pursue on their own behalf. Any County costs that may result from
future air emissions will be addressed on a separate basis.
Payment should be made to Contra Costa County and it should be sent to the
Auditor-Controller' s Office, 625 Court Street, Room 203, Martinez, CA 94553,
Attention: ' Ken Corcoran, Supervising Accountant II .
