April 1, 1986 COU* SUBJECT: Legislation: AB 4294 (Tucker) SPECIFIC REQUESTS) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for AB 4294 by Assemblyman Tucker. BACKGROUND: The existing County employees' retirement law of 1937 does not require employers to allow release time for employees who are elected to the Retirement Board to attend meetings of the Retirement Board, its committees, and to otherwise attend to Retirement Board business without loss of compensation and other benefits. AB 4294 has been introduced by Assemblyman Tucker. The bill would require employers to provide such release time for their employees who are elected members of the Retirement Board. The bill would also require the State to reimburse local agencies for the costs mandated by AB 4294. Contra Costa County already allows its employees who are elected to the Retirement Board a reasonable amount of released time to attend to Retirement Board business. As a result, AB 4294 would not impose any additional requirements beyond those which have been voluntarily undertaken by the County. The advantage of AB 4294 is that it would make this release time a State mandate thereby making the cost of salary and benefits for such release time eligible for State reimbursement.
