HomeMy WebLinkAboutMINUTES - 04221986 - T.4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 22, 1986 , by the following vote: AYES: Supervisors Fanden, McPeak, Torlakson and Powers NOES: None ABSENT: Supervisor Schroder ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Consider approval of findings for decision denying appeal of Donald J. Kalgaard and Alita Fisher from the Board of Appeals' approval of Land Use Permit 2079-85 in the Rodeo area. The Board on November 19 , 1985 denied the appeal of Donald J . Kalgaard and Alita C. Fisher from the Board of Appeals approval with conditions of the application filed by John Bessolo for LUP 2079-85 to establish a 24-unit apartment complex in the Rodeo area; and The Board has before it today for consideration proposed findings relative to the decision denying the aforesaid appeal; and Harvey Bragdon, Acting Director of Community Development, explained that the findings were to support the decision made by the Board on November 19 , 1985 . The Chairman invited public comments on the findings. He cautioned that, since there was pending litigation on the appeal and decision, the discussion would be limited to the nature of the findings only. Alita Fisher, 517 3rd Street, Rodeo, requested a correc- tion on page 2 , paragraph K, of the proposed findings. She said that the vote should be 3 to 1, with Mr. Powers absent. The Chair noted Mrs. Fisher' s comments. Donald Kalgaard, 517 3rd Street, Rodeo, commented on two notices he had received regarding today' s meeting. He asked a question concerning the date of the Board' s decision to deny his appeal, but did not comment on the accuracy of the findings, other than to state that the findings generally seemed inaccurate and that the vote on the Board' s decision should have been 3 to 1. No other comments having been received, Supervisor Fanden moved to approve the findings with a second by Supervisor McPeak. Supervisor Torlakson stated that he would vote no as he had on November 19 , 1985 . Supervisor Powers advised that since he had not been present at the November 19 , 1985 hearing, that he would have to abstain, and recommended that decision should be deferred until the same Board members who voted on the November 19 , 1985 decision could also be present. IT IS BY THE BOARD ORDERED that decision on the approval of findings for decision denying the appeal of Donald J. Kalgaard and Alita Fisher from the Board of Appeals' approval of LUP 2079-85 is DEFERRED to April 29 , 1986 as a determination item.
