The Chairman opened the public hearing. The following people appeared to speak to the issue: Claude Fernandez, 837 Redwood Drive, Danville; Robert Baker, 4057 Eagle Nest Lane, Danville; Dan Van Voorhis, 5130 Blackhawk Drive, Danville; Sanford Skaggs, 1855 Olympic Boulevard, Walnut Creek; Daniel Curtin, 1855 Olympic Boulevard, Walnut Creek. The Chairman closed the public hearing. The Board adopted Resolution 86/209 providing geologic hazard abatement extended services within County Service Area M-23 (Blackhawk Area) . The Board also adopted Resolution 86/210 approving the formation of a geologic hazard abatement district, Blackhawk Area, and Resolution 86/211 approving Joint Exercise Powers Agreement with Blackhawk Geologic Hazard Abatement District and Resolution 86/212 approving reimbursement of Blackhawk Corporation for emergency expenditures within County Service Area M-23. C. Section 25210.35) ) The Board of Supervisors of Contra Costa County RESOLVES that : On March 5, 1986, the Clerk of the Board of Supervisors received written requests from Supervisors Powers and Schroder for the commencement of proceedings by the Board for the addition of geologic hazard abatement extended services within County Service Area M-23 . The County Service Area Law (Govt . Code Section 25210 . 1 r,t sea. ) permits the addition of geologic hazard abatement extended services to the types of extended services furnished within the M-23 County Service Area. On March 18, 1986, the Board adopted Resolution No. 86/137, stating, among other things, the Board's intention to authorize the provision of geologic hazard abatement extended services within the M-23 County Service Area, fixing the public hearing upon the provision of such geologic hazard abatement extended services for April 22, 1986 at 2:30 p.m. , and directing that notice of the hearing be published pursuant to Govt . Code Section 6061 in the Valley Pioneer, a newspaper of general circulation published in the County. NOW, THEREFORE, THE BOARD OF SUPERVISORS HEREBY RESOLVES, FINDS, CERTIFIES AND ORDERS AS FOLLOWS: 1. A public hearing before this Board on the question of providing geologic hazard abatement extended services within the M-23 County Service Area was held on April 22, 1986 at 2:30 p.m. Notice thereof was published pursuant to Govt. Code Section 6061 in the Valley Pioneer, a newspaper of general circulation published in the County. The notice contained the information required by Govt. Code Section 25210.33, and publication of the notice was completed at least 7 days prior to the date of the hearing. 1 2. No written protests pertaining to the regularity or sufficiency of these proceedings or otherwise objecting to the provision of geologic hazard abatement extended services within the M-23 County Service Area were filed with the Clerk- of the Board on or before the time fixed for the hearing. No oral protests were made at the hearing to the provision of such extended services . 3 . Pursuant to the provisions of Govt. Code Section 25210 .31(b) , the addition of geologic hazard abatement extended services to the types of extended services to be provided within the M-23 County Service Area need not be approved by LAFCO. 4 . The Board finds that the proceedings prior to the adoption of this Resolution were valid and in conformity with the requirements of the County Service Area Law (Govt. Code Section 25210. 1 gt lag. ) . 5 . Geologic hazards, as that term is defined in Govt . Code Section 25210.4a(14) , presently exist in the M-23 County Service Area geographic area. 6. The Board finds that it is in the public interest to abate geologic hazards within the M-23 County Service Area and that public convenience and necessity require the addition of "geologic hazard abatement" extended services, as defined in Government Code Section 25210.4a(14) , to the types of extended services authorized to be performed within the M-23 County Service Area. 7. The addition of geologic hazard abatement extended services to the types of extended services to be provided within the M-23 County Service Area is exempt from the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 at sea. ) , in accordance with Public Resources Code Section 21080(b) (4) and State and County CEQA Guidelines Section 15269(c) . S. The Board hereby ORDERS that geologic hazard abatement extended services be added to the types of extended services to be provided within the M-23 County Service Area. 9 . The Board further ORDERS that the taxes levied annually upon all taxable property within the M-23 County Service Area, and any service charges collected pursuant to Govt. Code Section 25210.77a, shall also be used for the provision of geologic hazard abatement extended services in the M-23 County Service Area. 10.
