MICHAEL WALFORD, `IIPUBLIC WORKS DIRECTOR DATE: April 15, 1986 SUBJECT: Joint Exercise of Powers Agreement (NEPA) for the Oakley-Bethel Island Wastewater Management (OBIWMA)''` Specific Request(s) or Recommendation(s) & Bac group us i ca on RECOMMENDATION The Board of Supervisors of Contra Costa County, as the Board of Directors of Contra Costa County Sanitation District No. 15, approve 'the Joint Exercise of Powers Agreement for the Oakley-Bethel Island Waste Water Management Authority, and authorize the chairman to sign the agreement. FINANCIAL IMPACT This JEPA will have no effect on County funds. Execution of the JEPA will implement the Report on Cost Allocation Study for the Oakley Bethel Island Waste Water Management Authority dated November, 1985, and accepted by the Board January 21, 1986. REASONS FOR RECOMMENDATION/BACKGROUND On March 29, 1977 Contra Costa Sanitation District No. 15 (SO1.5) and the Oakley Sanitary District (OSO) entered into .a JEPA that created OBIWMA. The focus of that agreement was to create an agency to construct a sewage treatment facility to treat the sewage from both member agencies. The treatment facility has been treating the sewage from both member agencies since January 1, 1984 and was completed on December 31, 1984. The original JEPA specified a sewage flow for each district and a formula for splitting the costs between the two districts. , The flows from both of the districts are greater than that specified in the JEPA, and the formula for splitting the costs does not split the costs on a fair and equitable basis. Execution of this JEPA will implement the cost allocation with approximately $359,000 being refunded to SD15. The focus of this JEPA is on the continued operation of the Treatment Facility, and continuing the existence of OBIWMA. The Citizens Advisory Committee of Contra Costa County Sanitation District No. 1.5, and the Board of Directors of the Oakley-Bethel Island Wastewater Management Authority have studied the JEPA and have recommended its acceptance and implementation.
