SUBJECT:Legislation: Assembly Bill 2991 (Stirling)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for AB 2991 by Assemblyman Stirling.
BACKGROUND:
Existing law authorizes a peace officer to arrest a person
without a warrant if the peace officer reasonably believes that
the person has been driving under the influence of an alcoholic
beverage or drug, or both.
AB 2991 has been introduced by Assemblyman Stirling. AB 2991
adds Section 40300. 6 to the Vehicle Code. This section specifies
that the authorization for a peace officer to arrest a person
without a warrant is to be liberally interpreted in order to
permit arrests to be made within a reasonable time and distance
away from the scene of the traffic accident. According to
Sheriff Rainey, this bill is necessary in those cases where
drivers have fled the scene of an accident and are . not
apprehended for some time.
The Sheriff supports AB 2991. This office also recommends that
the Board of Supervisors support this bill in order to aid law
enforcement agencies in controlling drivers who have been driving
under the influence of an alcoholic beverage or drug.
