April 14, 1986 CQuq/ SUBJECT: Legislation: Senate Bill 1491 (Petris) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for SB 1491 by Senator Nicholas Petris. BACKGROUND: Existing law makes it a misdemeanor to sell tobacco products to a minor. Senator Petris has introduced SB 1491 which, in addition, would impose fines ranging from $500 to $1500 for a first offense, and from $750 to $6000 for each subsequent offense occurring within three years after the previous offense. SB 1491 would also require every person or firm which sells smokeless tobacco products to post a conspicuous warning as to the addictive and possible cancer-causing nature of smokeless tobacco, and would impose fines for violations of this posting requirement. Since SB 1491 furthers the Board' s position in opposition to smoking and use of potentially dangerous smokeless tobacco products, it is appropriate for the Board to support SB 1491.
