HomeMy WebLinkAboutMINUTES - 04011986 - T.4 ORDINANCE NO. 86-31 (Property Development Agreement for the NEWCASTLE DEVELOPMENT) The Contra Costa County Board of Supervisors ordains as follows: Section I . The Board hereby finds that the provisions of that certain Development Agreement (NEWCASTLE DEVELOPMENT, County File #3037-84 and Subdivision #6331) , between the County of Contra Costa and Shapell Industries of Northern California, a copy of which is on file with the Clerk of the Board and which has been recommended for approval by the County Zoning Adminis- trator, is consistent with the County' s General Plan and conditions of approval for the NEWCASTLE project. Section II . The Board hereby approves, pursuant to the authorization provided in Section 65864 et seq. , of the Govern- ment Code of the State of California, entering into that certain Development Agreement (NEWCASTLE DEVELOPMENT) between the County of Contra Costa and Shapell Industries, provided that the Agreement shall not be effective until this ordinance is operative. The Director of Community Development is author- ized to sign the agreement. Section III . If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such a decision shall not affect the validity of the remaining portions of this ordinance. The Board hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance irrespective of the unconstitutionality or invalidity of any section, subsection, subdivision, paragraph, sentence, clause or phrase. Section IV. EFFECTIVE DATE. This ordinance become effective 30 days after passage, and within 15 days of passage shall be published once with the names of supervisors voting for or against it in the Contra Costa Times, a newspaper published in this County but shall not become operative until the Agree- ment is approved by the Community Development Department and County Counsel and their approval is indicated thereon.
