NOES: None . ABSENT: None . ABSTAIN: None. SUBJECT: Determination of Property Tax Transfer) for the Consolidation of the Contra ) Costa Mosquito Abatement District ) RESOLUTION NO. 86/ 165 No. 1 & the Diablo Valley Mosquito ) Abatement District (LAFC 86-7) ) WHEREAS, the Boards of Trustees of the Contra 'Costa Mosquito Abatement District No. 1 and the Diablo Valley Mosquito Abatement District have initiated proceedings for the consolidation of the two mosquito abatement districts; and WHEREAS, Section 99 of the Revenue and Taxation Code provides that the Board of Supervisors shall negotiate a property tax exchange agreement on behalf of districts involved in a jurisdictional change affecting one or more special districts; and WHEREAS, the Contra Costa Mosquito Abatement District No. 1 and the Diablo Valley Mosquito Abatement District have agreed that the property tax revenues of the two districts shall be transferred to the new mosquito abatement district resulting from the consolidation. NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE that 100 percent of the property tax accruing to the Contra Costa Mosquito Abatement District No. 1 and the Diablo Valley Mosquito Abatement District from the affected territory of the proposed consolidation shall be transferred to the new consolidated district for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. The terms of the property tax transfer shall apply in subsequent years unless changed by the mutual agreement of the affected agencies or subsequent jurisdictional changes. This resolution does not change the property tax revenues accruing to other agencies servicing the subject territory or the affected agencies' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission.
