SPECIFIC REQUEST(S) IOR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position of support for AB 4389 by Assemblyman Baker.
BACKGROUND:
One of the resolutions which the Board submitted to CSAC last
fall at the suggestion of Consolidated Fire District Chief
William Maxfield was to seek legislation which would extend the
time for commencing prosecution for certain arson offenses from
three years to six years.
Assemblyman Baker has introduced AB 4389 which provides that the
prosecution of crimes of arson on an inhabited structure or
property and a crime of arson of a structure or forest land must
be commenced within six years. This is an increase from the
current law' which requires prosecution be undertaken within three
years after, commission of the offense.
Chief Maxfield' s concern with the existing law is that frequently
arson investigations are extremely complex and obtaining the
necessary evidence to commence prosecution is sometimes
impossible within the existing three-year limit.
Since AB 4389 responds to a resolution already endorsed by the
Board, it seems appropriate for the Board to endorse AB 4389.
