SUBJECT: Sale of vacated County rights of way to the Redevelopment Agency SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: A. Action of Contra Costa County 1. Approve the sale of certain vacated road rights of way, described as parcels P-3, P-19, S-6 and S-8, in the Pleasant Hill BART Station Area, to the Redevelopment Agency. 2. Authorize the Chairman of the Board of Supervisors to execute a Purchase and Sale Agreement (Contract No. RA 86 - 17 on file with the Clerk of the Board) with the Agency providing for a total sales price of $265,432.00 to be paid under the terms of the agreement. 3. Authorize the Chairman of the Board of Supervisors to execute deeds on behalf of the County, and direct the Real Property Division to deliver the deeds to the Agency following the effective recordation of the respective resolution of vacation. B. Action of the Redevelopment Agency 1. Approve the purchase of the subject vacated rights of way from the County. 2. Authorize the Executive Director or his designee to execute a Purchase and Sale Agreement (Contract No. RA 86 - 17 on file with the the Clerk of the Board) with the County providing for a total sales price of $265,432.00 to be paid under the terms of the agreement. Authorize the Executive Director or his Designee to execute such other documents and take such actions as are reasonably necessary to carry out the terms of the agreement. 4. Amend the Redevelopment Agency's Fiscal Year 1985-86 Budget accordingly. FINANCIAL IMPACT: The total sale price of the property is $265,432.00, to be paid to the County from tax increments generated by the Redevelopment Project. The sale price is the estimated fair market value of the property consistent with qualified appraisals. Since the Agency will pay the County over time dependent upon the , availability of tax increment revenue, the County will receive interest on the unpaid balance at the prime rate of interest plus 1%, which is consistent with previous Agreements. These purchases were not anticipated in the Agency's Fiscal Year 1985-86 Budget, which must be amended accordingly. BACKGROUND/REASONS FOR RECOMMENDATIONS: The Redevelopment Agency has applied for the vacation and abandonment of several existing rights of way in the Pleasant Hill BART Station Area Redevelopment Project no longer needed due to the reconfiguration of the traffic circulation system. The vacations are necessary for the complete assembly of various development areas within the project pursuant to the Redevelopment Plan. These parcels, which the County owns or expects to own upon relinquishment by Caltrans, are to be conveyed to the Redevelopment Agency for reconveyance to the designated developers under the terms of Disposition and Development Agreements (DDA) negotiated with the developer. Conveyance of particular parcels to the Agency will take place upon the effective date of vacation. Subsequent reconveyance to the developer will be done as provided for in the respective DDA. O
