SUBJECT: Legislation: Assembly Bill 3079 (Hughes)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
Adopt a position of the County/Redevelopment Agency in opposition to Assembly
Bill 3079 by Assemblyman Hughes requiring Redevelopment Agencies to share tax
increments with school districts under certain circumstances.
FINANCIAL IMPACT:
Potential loss of up to 27 percent of tax increment revenue in the Pleasant
Hill BART Station Area Redevelopment Project and the reduction of available
funds in projects being contemplated.
There would also be a potential loss revenue to County. Diversion of tax
increments to school districts may lengthen the time period for ending existing
city redevelopment projects within the County, which would delay the return of
full property tax to the County and other taxing agencies.
BACKGROUND/REASONS FOR RECOMMENDATION:
Existing law generally permits an agency to pay to any taxing agency with
territory located within a project area, including school districts, any amount
of money which the agency finds is necessary and appropriate to alleviate any
financial burden or detriment caused to that taxing agency by a redevelopment
project.
This bill would require a redevelopment agency to amend the redeveloment plan
and utilize any portion of the tax revenues, which would have been received by
the school district in the absence of a provision for tax increment financing,
to redevelop or construct shcool facilities, if the governing body of a school
district finds that conditions of overcrowding exist in attendance areas that
serve students who reside in housing acquired, constructed, developed, or
rehabilitated in accordance with other specified provisions of the community
redevelopment law.

This bill would require a Redevelopment Agency to conduct a Public Hearing if
the governing body of a school district finds, that conditions of overcrowding
exist in attendance areas that serve pupils who reside in housing located
within or adjacent to a project area and that the conditions of overcrowding
result from actions taken by the Agency in implementing any Redevelopment Plan
adopted before January 1, 1987. At the Hearing, public testimony would be
taken identifying the fiscal effects of the Redevelopment Plan on the impacted
attendance areas and suggesting possible revisions to the plan that would
alleviate or eliminate that overcrowding. The Bill would require the Agency,
to consider amendments to 'the plan necessary to alleviate or eliminate that
overcrowding and would permit the agency to recommend those amendments for
adoption by the legislative body.
In the case of the County's Pleasant Hill BART project, a fiscal review has
previously been done to determine the impacts of that project on the local
school district and other taxing agencies. This Bill would merely duplicate
that previous effort and consideration.
In the case of City Redevelopment projects within the County, this bill could
result in the Amendment of existing projects such that a certain amount of tax
increment would be diverted to local school districts. To the extent this
happens, the affected project timeframes would have to be extended, thereby
extending the time before full property taxes from the project would be
returned to the County and other taxing agencies.
