Bragdon, Director of Community Development Cwtra Perfecto Villarreal , Executive Director, Housing Authority costa t DATE: March 28, 1986 C SUBJECT: SB 338 - Housing for Seniors and Handicapped Persons SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDATION Express support for SB 338 (Garamendi ) - Housing for Senior and Handicapped Persons - as recommended by the Housing Authority Advisory Commission, and suggest certain amendments and concerns as recommended by the Director of Community Development; and authorize the Chairman to execute letters to the County's State legislative delegation. II. BACKGROUND SB 338 (Garamendi ) would place before the voters an initiative authorizing the State to issue tax exempt general obligation bonds to finance senior and handicapped rental hous- ing. The bill., as currently drafted, would, if approved by the voters, authorize the is- suance of $200 million in such bonds. General obligation bonds for multi-family housing would be subject to proposed federal requirements for non-governmental (or non-essential function) bonds contained in HR 3838 - the House Tax Reform Act. Among other items, the proposed tax reform legislation would require that a uniform volume cap .be established at the State level . Multifamily bonds may have to compete with other types of non-governmental bonds for the volume authority. Further, local issuers may have to compete with State issuers for a fair portion of the volume cap authority. In as much as the State Treasurer's Office may ultimately be re- sponsible for the creation of an allocation system, it is important that local issuers be .provided sufficient authority. Additional multi-family bonding authority as contemplated by SB 338 should not be used as a basis for providing a greater share of the volume cap authority to State issuers. Section 50846 of the Health and Safety Code, as proposed in the bill , would instruct the Department of Housing and Community Development to prepare regulations that grant priority in the allocation of funds to developments which meet various requirements. Section 50846(c) gives priority to the lowest cost projects, taking into account local land, mate- rial , and cost factors. This portion of the bill should be amended to specifically take into account local design factors. Projects which are simply low cost may not be accept- able to local communities. There is a need to preserve local design and aesthetic stan- dards as it relates to these projects in order to assure community acceptance. Section 50846(f) gives priority to projects built to minimum local building and housing codes. Again, concern regarding community acceptability should be taken into account. This portion of the bill should be amended to take into account such additional standards to comply with local design and aesthetic standards. III. FINANCIAL IMPACT None.
