HomeMy WebLinkAboutMINUTES - 03041986 - 1.25 To, BOARD OF SUPERVISORS FROM Phil Batchelor, County Administrator Contra; February 26, 1986 Costa DATE: Coi "J SUBJECT: Legislation: SB 1809 SPECIFIC REQUEST(S) OR RECOMMENDATION(_S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of opposition to SB 1809 (Doolittle) , which would allow special districts, school districts, and community college districts to consolidate their elections with the statewide primary or general election, and restricts the Board of Supervisors ' ability to deny consolidation. BACKGROUND: On February 25, 1986, the Board voted to oppose AB 2605 by Assemblyman Robinson and AB 2737 by Assemblyman Klehs, both of which are similar to SB 1809 by Senator Doolittle. SB 1809 is broader than either of the other bills in that it combines the authority for special districts, school districts, and community college districts to consolidate their elections in a single bill. Under SB 1809, the consolidation requires approval by the Board of Supervisors. However, no criteria are provided which provide any grounds for denying the consolidation, and the Election Supervisor is concerned that the section may be interpreted as simply requiring approval of the consolidation as a ministerial act. The bill would be more acceptable if it provided that the Board of Supervisors could deny the consolidation when, in the opinion of the Board of Supervisors, consolidation of the election would make the ballot so long and cumbersome that it would result in significant delays at polling places. In the absence of such language, it is our recommendation that the Board oppose SB 1809.
