THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on March 25 , 1986 , by the following vote:
AYES: Supervisors Fanden, Schroder, Torlakson and Powers
NOES: None
ABSENT: Supervisor McPeak
ABSTAIN: None

SUBJECT : Rezoning 2657-RZ and Development Plan 3064-85 filed by
Desco Investment, Inc. , LaRossa, Williams & Connelly,
Walnut Creek area.
This being the time for hearing on the recommendation of
the County Planning Commission with respect to rezoning application
2657-RZ filed by Desco Investment, Inc. (applicant) and Martha P.
LaRossa, Carmen J. Williams, William E. & Katherine L. Connelly
(owners) to rezone approximately 1.49 acres from Single Family
Residential District (R-10) to Planned Unit District (P-1) , together
with application for approval of Development Plan 3064-85 for 36
residential units located on the southerly side of Boulevard Way
approximately 150 feet westerly of Saranap Avenue, in the Walnut
Creek area; and
Harvey Bragdon, Assistant Director of Community
Development, described the property site and advised that a Negative
Declaration of Environmental Significance was posted for this
project.
The Chairman declared the hearing open.
Mr. Albert Cabellon, representing the applicant, requested
that Condition of Approval No. 9 imposed by the County Planning
Commission requiring separate sewer hook-ups to each dwelling unit
be removed. He submitted a copy of a letter from the Central Contra
Costa Sanitary District advising that the proposed development can
be served by one six-inch single sewer.
Mr. Bragdon commented that the Community Development had
no problem with that request.
No one else appeared to speak. The Chairman declared the
hearing closed.
As recommended by Supervisor Schroder, IT IS BY THE BOARD
ORDERED that rezoning application 2657-RZ and Development Plan
3064-85 are APPROVED, subject to the conditions imposed by the
County Planning Commission and revised by this Board (Exhibit A
attached hereto and by reference made a part hereof.
IT IS FURTHER ORDERED that Ordinance Number 86-28 giving
effect to the aforesaid rezoning is INTRODUCED, reading waived and
April 8, 1986 is set for adoption of same.
In approving the aforesaid applications, the Board .concurs
in and makes the findings as shown in the County Planning
Commission' s Resolution Number 14-1986 .
I hereby certify that this is a true and correct copy of
an action taken and entered on the minutes of the
Board of Supervisors on the date shown.

EXHIBIT A
CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3064-85:
1. Development shall be as shown on plans submitted with
the application dated received December 23, 1985 by the
Community Development Department.
2. The guide for development shall be the Multiple Resi-
dential District (M-17) . Any request by the future
residents within this development for modification to
the M-17 requirements shall be made by recommendation
from the homeowner' s association to the Community
Development Department with the filing for a building
permit.
3. Comply with the landscape and irrigation requirements
as follows:
A. Prior to issuance of a building permit, a land-
scape and irrigation plan shall be submitted for
review and approval by the County Zoning Adminis-
trator and the County Public Works Department.
Landscaping and irrigation shall be completed
prior to occupancy.
B. Significant landscaping shall be provided at the
frontage and. boundaries of the site. All initial
landscaping shall be of a size so that a mature
appearance will be attained within approximately
three years of planting.
C. Existing trees shall be preserved as indicated on
plans submitted with the application and protected
at the dripline during grading and building
operations.
4. Prior to issuance of a building permit, elevations and
architectural design of buildings and structures,
including carports, trash enclosures, etc. , shall be
subject to final review and approval by the County
Zoning Administrator. The roofs and exterior walls
shall be free of such objects as air conditioning
equipment, television aerials, etc. , or screened from
view. Exterior lights shall be deflected so that
lights shine onto applicant' s property and not toward
adjacent properties.
5. ;A sign directory displaying the numbers and location of
all dwelling units in a diagram manner shall be posted
at the main pedestrian entrance to the project in a
location and of a size easily readable by the fire
district. All units shall have house numbers or unit
identification visible at all times which may require
illumination.

6. A geotechnical report providing for foundation design
and site grading shall be submitted to the Community
Development Department (County Geologist) and Building
Inspection Departments prior to issuance of a building
or grading permit.
7. If, archaeologic materials are uncovered during grading,
trenching or other on-site excavation, earthwork within
30 meters of these materials shall be stopped until a
professional archaeologist who is certified by the
Society of California Archaeology (SCA) and/or the
Society of Professional Archaeology (SOPA) has had an
opportunity to evaluate the significance of the find
and suggest appropriate mitigation measures, if they
are deemed necessary.
8. Comply with the drainage, road improvements, traffic
and utility requirements as follows:
A. In accordance with Section 82-2.014 of the County Ordinance Code, this
development shall conform to the requirements of Division 914 Drainngf ) of
the Subdivision Ordinance, unless exceptions are specifically granted.
B. Extend the existing downstream storm drain system to the east side of Blade
Court, or, reach an agreement acceptable to the Contra Costa County Flood
Control District to mitigate the drainage problems.
C. Unless exceptions are specifically granted, comply with the requirements of
Division 1006 (Road Dedication and Setbacks) of the County Ordinance Code.
This includes the following:
1) Convey to the County, by Offer of Dedication, approximately 10 feet to
20 feet of additional right of way on Boulevard Way as required for the
planned future width of 84 feet. The Offer of Dedication shall be in
accordance with County Drawing PA 3851-69.
2) Construct curb, 6-foot 6-inch sidewalk (width measured from curb face),
necessary longitudinal and transverse drainage, and necessary pavement
widening on Boulevard Way. The face of curb shall be located 10 feet
from the widened right of way.
3) Install street lights on Boulevard Way. The final number and location of
the lights will be determined by the County Traffic Engineer.
D. Construct the on-site driveway system to current County private road
standards with a minimum width of 20 feet.
E. Install all new utility distribution services underground.
F. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across the sidewalk and driveway.

G. Furnish proof to the Public Works Department, Engineering Services Division,
of the acquisition of all necessary rights of entry, permits and/or easements
for the construction of off-site, temporary or permanent, road and drainage
improvements. '
H. Submit improvement plans prepared by a registered civil engineer to the
Public Works Department, Engineering Services Division, for review; pay the
inspection, plan review and applicable lighting fees. These plans shall include
any necessary traffic signage and striping plans for review by the County
Traffic Engineer. The improvement plans shall be submitted to the Public
Works Department, Engineering Services Division, prior to the issuance of
any building permit. The review of improvement plans and payment of all
fees shall be completed prior to the clearance of any building for final
inspection by the Public Works Department. If final inspection is requested
prior to construction of improvements, the applicant shall execute a road
improvement agreement with Contra Costa County and post bonds required
by the agreement to guarantee completion of the work.
I. Widen the entrance throat to the driveway to at least 16-foot lane widths or
eliminate the driveways median island.
J. Relocate the security gate to at least 50 feet behind the Boulevard Way right
of way line.
K. Provide a median opening near the security gate to facilitate redirection of
cars to Boulevard Way when they determine they cannot enter this
development.
L. Install a stop sign along the egress driveway at Boulevard `Nay.
9. The Development may be served by a single sewer connection as determined by the
Central Contra Costa Sanitary District.
The following statements are not conditions of approval, however, the applicant should be
aware of these comments prior to attempting to secure building permits.
A. The Contra Costa County Consolidated Fire District (attached).

Dear Mr. Turner:
We have reviewed the development plan to establish a 36-unit residential building
at the subject location. This project is regulated by codes and ordinances
administered by this Fire District relative to Contra Costa County Ordinance 83/44.
If approved by your office, the following shall be required:
1. The developer shall submit two (2) complete sets of plans and specifications
of the subject project, including required built-in fire protection systems,
to this office for review and approval prior to construction to insure
compliance with minimum requirements related to fire and life safety. Plan
review fees will be assessed at that time.

2. The developer shall provide an adequate and teliable water supply for fire
protection with a minimum fire flow of 2,500 GPM. Required flow shall be
delivered from not more than 3 hydrants flowing simultaneously while
maintaining 20 pounds residual pressure in the main.

3. The developer shall provide one hydrant of the East Bay type. Location of
hydrants will be on Boulevard Way near the building. _

4. The hydrant shall be installed and in service prior to combustible construction.

5. The building shall be protected throughout with an approved automatic fire
Sprinkler system, be of Type V-1 hour construction, and be equipped with an
approved fire alarm system.
