RECOMMENDATIONS
Initiate a boundary reorganization to annex the majority of those areas to the:
Central Contra Costa Sanitary District
East Bay Municipal Utility District
County Service Area R-7 - Zone B
Community Services Area L-42
and apply to LAFCO by Resolution for that boundary reorganization.
Request the Local Agency Formation Commission (LAFCO) of Contra Costa County to
amend the sewer, water, and other appropriate spheres of influence to include the lands
covered by the West Branch, Hansen Lane, and Dougherty Road General Plan amendments in
the Crow Canyon Road Extension Corridor.
FINANCIAL IMPACT
The property owners affected by this request have agreed to pay all the necessary State and
LAFCO fees to complete the boundary reorganization. There are other minor staff costs to
cover the receiving of the fee and preparing the submittals to LAFCO.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
1. Pursuant to the District Reorganization Act (Gov. C. Subsections 56000 et
seq. ) , this Board hereby makes application to the Local Agency Formation
Commission for approval of a reorganization consisting of simultaneous
annexation of the same territories to EBMUD, Central Contra Costa County
Sanitary District, County Service Area L-42, and County Service Area R-7 Zone B.
A description of the exterior boundaries of the territories to be annexed is
attached as Exhibit A hereto.
2. The territories proposed for annexation are legally uninhabited.
3. The reason for the proposal is to further County policy of logical and
orderly development, as reflected by the General Plan for the subject areas.
The Applicant has made special financial commitments to the County to advance
that General Plan policy.
4. This Board also requests that LAFCO amend the sewer, water and urban
service district spheres of influence to include the territories shown on
Exhibit A.
5. This Board hereby requests that the Local Agency Formation Commission
conduct preliminary proceedings and approved the aforesaid reorganization.

ATTACHMENT A
CONSIDERATION OF BOUNDARY REORGANIZATION REQUEST
CROW CANYON ROAD EXTENSION
REQUEST INITIATION
Mr. Jonathan Cohen submitted a letter to the Board of Supervisors requesting that the
Board initiate both a sphere of influence change and a boundary reorganization for the
Crow Canyon Road Extension Corridor to the Local Agency Formation Commission
(LAFCO) of Contra Costa County. A copy of that request is Attachment B. The Board
referred that request to the Community Development Director for report. This is the
response to the Board request.
COUNTY ACTIONS IN AREA TO DATE
The Crow Canyon Road Extension Corridor is the name County staff has applied to the
area which will be served by the eastward extension of Crow Canyon Road from the
Canyon Lakes development to Camino Tassajara Road. In 1978 when the County initiated
the Tassajara rezoning (2218-RZ) to more stringent agricultural districts, this area was
originally considered for rezoning, however, the Board decided to retain the pre-existing
zoning until the parcels could be studied on the merits of the area urbanizing.
In 1981, three separate General Plan amendment requests were received within this area.
They were:
o The West Branch request covering 400 acres of the 3,000 acre Shapell land holding
located along both sides of Dougherty Road south of Camino Tassajara.
o The Hansen Lane proposal covering 240 acres located both north and south of
Camino Tassajara.
o The Dougherty Road General Plan amendment with 500 acres and seven property
owners involved found between the other 2 amendment requests.
Since the requests were received on differing dates they were initially processed
separately and an individual EIR was prepared on each amendment. Those three EIR's
covered not only the issues of development concern to the County but LAFCO issues as
well.
Staff reports were prepared on the projects (which lead to major changes in the
proposals), numerous hearings on the amendments were held before the San Ramon Valley
Area Planning Commission, and ultimately the Board approved those three amendments
for urban development in late 1984 and early 1985 after substantial modification. See
Map 1 for the location of these projects and for the County General Plan land use
designations.

SPHERE OF INFLUENCE REQUEST
State law requires LAFCO's to establish spheres of influence for each local governmental
agency and further requires that annexation to the respective agencies must be consistent
with their spheres. State law allows for the Board to apply for boundary changes; the
subject proposal would require corresponding sphere of influence amendments as well. In
1984 LAFCO considered the spheres of influence of the cities of San Ramon and Danville.
The West Branch General Plan amendment area was placed within the City of San
Ramon's sphere of influence. Danville's city sphere was amended to include both the
Dougherty Road and most of the Hansen Lane amendment areas. The Hansen Lane area
includes lands both north and south of Camino Tassajara. Since the County had
determined the 40 acres of the Hansen Lane amendment area south of Camino Tassajara
was to remain in Open Space, it was not included within the Danville sphere of influence.
It was-presumed by LAFCO that the lands -within- the city sphere of influence would
receive urban levels of sewer and water. LAFCO took into account the pending County
General Plan while they were determining city spheres and the County General Plans were
a major consideration in LAFCO's final determination. It would appear appropriate for
the County to request LAFCO sphere amendments for ubran service districts as a
continuation of the County's past actions in adopting those General Plan amendments.
Recommendation
The Board of Supervisors should request LAFCO to amend the sphere of influence
for EBMUD, Central Contra Costa Sanitary District, County Service Area R-7 (Zone
B), and Street Lighting District L-42 (as shown on Map A).
BOUNDARY REORGANIZATION
Mr. Cohen also requests that the Board apply to LAFCO for a boundary reorganization
which would annex several properties shown on his petition (Attachment B) to the:
Central Contra Costa Sanitary District
East Bay Municipal Utilities District
County Service Area R-7 Zone B (recreation)
County Service Area L-42 (street lighting)
Throughout the review of the General Plan amendments for these areas, there was a
presumption that annexation to these districts would occur. Such boundary changes are
clearly covered by the County EIR's on these projects and is in conformity with their
environmental findings.
Normally, the next step after adoption of the General Plans would be for property owners
to apply for rezonings of their lands and after they are approved, efforts would be made
to annex the lands to the appropriate urban service districts. However, due to complex
process of insuring adequate urban services to this Tassajara area, the property owners
wish to pursue annexation at this time. Some of the reasons for this are:
- One condition of the Canyon Lakes approval was the right of that developer to
initiate construction of Crow Canyon Road Extension from the easterly boundary of

Canyon Lakes to Camino Tassajara Road prior to the road extension being
constructed by area developers as frontage improvements. This was to be done to
improve circulation in the Blackhawk Ranch area. Canyon Lakes has initiated that
condition and has prepared the construction plans for this roadway. As part of this
effort, Shapell (owner of West Branch and Diablo Ventures (owner of a major portion
of the Dougherty Road amendment area) have gifted six lanes of right-of-way across
their property to the County for the Crow Canyon Road Extension. They have done
that at the request of the County and without the assurances of having a
development plan approved for their properties.
EBMUD is currently planning and constructing water facilities through a portion of
these properties. The Board of Directors of that District has authorized their
General Manager to execute a Financial Guarantee Agreement to assure water
facilities now under construction will be -sized to ultimately serve the subject
properties. The EBMUD Board of Directors has declined to sign a parallel
agreement initiating annexation to the District. The Board has thus agreed to
oversize the facilities to serve the area (with financial assurances of these property
owners) but has not acted directly to seek their annexation. This dichotomy may be
tied to the fact that the District is under a lawsuit on their EIR for providing
facilities in the San Ramon Valley. It is the property owners view that this actionn
provides a hardship to them and that annexation should be assured at this point in
the development process.
For these reasons, among others, Mr. Cohen has requested this boundary reorganization.
From our staff viewpoint, the County, by its General Plan policy, has determined that
development is appropriate, has tentatively canceled the West Branch and Hansen Lane
Agricultural Preserve contracts and is committed to allow the area to develop (basically
residential) to balance the jobs being created at Bishop Ranch. It would seem a logical
extension of previous Board decisions for the County to become an applicant for the
requested boundary reorganization. Such an application should be for the area of the
Dougherty Road, West Branch, and Hansen Lane General Plan amendments where the
properties are designated for urban development. Such application should be contingent
upon the property owners paying the LAFCO and State processing fees to accomplish the
boundary reorganization. The Hansen Lane holdings south of Camino Tassajara
(designated Open Space) should be excluded from this application. The annexation request
would then include all lands designed for some urban uses on the County General Plan and
would include several properties not included in Mr. Cohen's request (Appendix A).
Recommendation
Apply, by the attached Resolution, for a boundary reorganization to annex the lands
shown on Map A to the aforementioned districts and County service areas as
described on Attachment C.

Crow Canyon Corridor Extension Area
Dear Chairwoman Fanden and Members of the Board:
This letter serves as a request by the undersigned for the
Board of Supervisors pursuant to California Government Code
Section 56130 to initiate by resolution an application for
preliminary proceedings before Contra Costa uouity LAFCO a multi-
- district reorganization. The purpose of the reorganization would
be to change and extend the Spheres of Influence and the ultimate
service boundaries -and annex the Crow Canyon corridor Extension
Properties (the Subjecc `Properties) described in Exhibit A
attached hereto into the boundaries of the following districts:
a. Central Contra Costa Sanitary District (CCCSD) ;
b. Community Service Area R 7 - Zone B (CSA-R7) ;
C. Community Service Area L 42 (CSA-L42) ; and
d. East Bay Municipal Utility District (EBMUD) .
These districts are the likely and proximate governmental
agencies to serve the Crow Canyon Corridor Extension Area.
Currently, the spheres of influence, district boundaries and
ultimate service boundaries of EBMUD and CCCSD are adjacent to
the Subject Properties. The West Branch, Hansen Lane and North
Dougherty Hills General Plan Amendments adopted by the Board of
Supervisors on November 17 , 1984 and in March of 1985 designate
the Subject Properties as suitable locations for housing
resources to meet the serious shortfall of supply caused by the
-.- -large- scale .. commercial...and, office -development. in _ the _.San_ Ramon
Valley. The . individual Environmental Impact Reports for the
aforementioned general plan amendments discussed the extension of
the spheres of influence of CCCSD, EBMUD and CSA-R7 Zone B and
CSA-L42 and annexation of the Subject Properties into these
districts. These EIR' s should serve as the environmental.
documentation necessary to satisfy CEQA for the proposed";
reorganization. The requested reorganization is part of a -
planning and development process for this area that not only .
involves land use changes but also large scale circulation .
improvements including construction of Crow Canyon Road from the
Canyon Lakes development to Camino Tassajara.
In regard to- the suitability of extension of the sphere of
influence of CCCSD and annexation of the Subject Properties
thereto, CCCSD operates sewer -trunk facilities that intersect the
Subject Properties to serve the Blackhawk development. These
facilities would be utilized and expanded to provide service to
the Subject Properties. The Developers of the Subject Properties
have been coordinating with CCCSD the planning for extension of
sewer service to this area.
Within the affected area, CSA-R7 and CSA-L42 respectively,
are the appropriate agencies to coordinate the planning and
development of local parks facilities and street lighting. The
EIR' s prepared for the aforementioned general plan amendments

bidentify that the Subject Properties should be required to be
annexed to - these community service areas in order . to satisfy.

EBMUD is currently planning and constructing water facil-
ities through a portion of the Subject Properties and the Board
of Directors of EBMUD has authorized the General Manager to
execute a Financial Guarantee Agreement with the Developers of
the Subject Properties to assure that the construction of water
--- -- -- -facilities-- now• underway- will -be -. sized...to.---ultimately_serve the
Subject Properties if they are annexed to the District.
Of the territory involved in the district reorganization,
three parcels are currently uninhabited and three parcels are
inhabited. A breakdown of the inhabited and uninhabited parcels
to be included within this reorganization is attached hereto as,-,
Exhibit B. Two of the three inhabited parcels are located;:.,
adjacent to Hansen Lane and were not included in any of the:
aforementioned general plan amendments. They have been included',
in the area of annexation because of their proximity to existing
sewers and future water transmission facilities.
Attached hereto as Exhibit C is a legal description desig-
nating the exterior boundaries of the territory to be annexed to
the respective districts. In..-addition, the legal description of
the proposed extended spheres of influence of EBMUD and CCCSD is
attached hereto as Exhibit D.
No terms and conditions of these annexations are proposed at
this time.

It would be greatly appreciated if the Board of Supervisors
would consider initiating this district reorganization subsequent
to review by the Community Development -Department.
