RECOMMENDATION•
Adopt a position of support for Assembly Constitutional
Amendment 44 by Assemblyman Cortese.
BACKGROUND:
ACA 44 has been introduced by Assemblyman Cortese at the request
of CSAC. ACA 44 would expand the provisions which may be
included in a county charter. It would provide that a charter
county may make and enforce within its limits all ordinances,
regulations, and administrative policies and procedures with
respect to county affairs. It would provide that when a county
has adopted a charter, the general laws pertaining to matters
which a charter may provide for and those which are county
affairs are superseded by the charter. In these matters, it
would also provide' that a county charter prevails over any
provision of the Constitution.
Since ACA 44 strengthens the role of charter counties in relation
to the State, and provides a substantially enhanced degree of
local control over local issues and problems, it. deserves the
support of the Board of Supervisors. The intent of ACA 44 is to
provide charter counties with the same degree of authority and
autonomy that charter cities presently enjoy.

RECOMMENDATION•
Adopt a position of support for AB 4043 by Assemblyman Cortese.
BACKGROUND:
As a part of its legislative effort to provide a stable source of
revenue to counties, CSAC has asked Assemblyman Cortese to
introduce AB 4043 . ` This bill would, effective January 1, 1987,
transfer sales tax revenue equivalent to 1/4% rate to the County
Sales Tax Fund. This fund would be appropriated to the
Controller for allocation to the County on the basis of
population.
A rate of 1/4% is estimated to raise $600,000,000 statewide
annually. Since Contra Costa County represents approximately
2 .77% of the statewide population based on the 1980 census, and
approximately 2.720 of the statewide population on July 1, 1985,
it is reasonable to estimate that the County would receive
approximately $16 . 2 million from passage of AB 4043 for the
1987-88 fiscal year, based on 2.7% of the statewide total.
Given the situation the State is faced with this year, where it
may reach its Gann 'expenditure limit and not be able to spend all
the revenue it takes in, a bill such as AB 4043 may present a "
method for the State to transfer a portion of its revenue to
counties who have pressing, unmet needs and an inability to
independently raise additional revenue. The bill would provide
counties with an independent source of revenue with no
programmatic demands on it.
Since AB 4043 is sponsored by CSAC and is consistent with the
Board' s standing policy of seeking an independent source of
revenue without increasing general taxes, AB 4043 merits the
support of the Board of Supervisors..

RECOMMENDATION:
Adopt a position of support for AB 4144 by Assemblyman Cortese.
BACKGROUND:
AB 4144 is contingent upon the passage by the voters of ACA 44.
ACA 44 generally would give charter counties the same authority
and degree of autonomy in local affairs as charter cities now
have. AB 4144 would extend to general law counties the same
authority to levy taxes that charter counties have, thereby
providing general law counties the same authority to levy taxes
that charter cities now have.
AB 4144 is sponsored by CSAC and is a part of a package of
legislation intended to provide counties with the local autonomy
and independent revenue sources that are essential in order to
maintain counties as viable entities of local governments.
Cities have much broader authority to license businesses and to
tax for revenue purposes than do counties. AB 4144 would put
counties and cities on a more equal footing in this regard.
In view of the above, it is recommended that the Board of
Supervisors support AB 4144.
