SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for SB 1707 introduced by Senator
Maddy.
BACKGROUND:
The California Land Conservation Act of 1965, better known as the
Williamson Act, was passed to preserve agricultural land from the
pressures of unnecessary urban conversion. The Williamson Act
established a program of voluntary contracts between land owners
and counties which serve to protect agricultural and open space
lands from premature development by offering substantial
reductions in property taxes to land owners. In return, the
State reimburses counties at a fixed rate per acre for all land
under Williamson Act contracts.
Currently, each acre of urban prime agricultural land which is
within three miles of an incorporated city with a population of
25,000 or more is reimbursed at $8 . 00. Other prime agricultural
land which is within three miles of the boundaries of an
incorporated city with a population of 15,000 or more is
reimbursed at $5. 00 per acre. All other prime agricultural land
is reimbursed at $1 . 00 per acre. All land other than prime
agricultural land which is devoted to open space use of statewide
significance is reimbursed at 40 cents per acre. These
reimbursement rates have not been increased for at least ten
years.
Under the existing reimbursement schedule, Contra Costa County
claimed $54,030 for the 1985-86 fiscal year. This' amount has
been calculated by the Assessor to leave a remaining net property
tax loss of $510,767 based on the difference between the
assessment made under the Williamson Act and the assessment which
would be made if the property were assessed without regard for
Williamson Act contracts.

The Fresno County Assessor has requested Senator Maddy to
introduce SB 1707 to increase the reimbursement rates for acreage
under Williamson Act contracts. As is indicated in the following
table, application of the SB 1707 schedule would result in
payments to Contra Costa County of $158,233 . 20 for a net increase
of $104,203 . 20. While this is only a portion of the $510,000
current property tax loss, it is certainly an improvement over
the existing reimbursement schedule. As a result, it is
recommended that the Board of Supervisors endorse SB 1707.
