SUBJECT: City of Martinez Request for County Support of an Amendment
of the Bay Conservation and Development Commission's San
Francisco Bay Plan
SPECIFIC REQUEST(S) OR RECOMMENDATION(.S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION: Concur with the Martinez City Council 's Request (letter from
Mayor Menesini of October 29, 1.985) that the Board of Supervisors support the
City's request to the San Francisco Bay Conservation and Development Commission for
an amendment to BCDC's S.F. Bay Plan which would eliminate the Water-related Industry
designation on the CAZ Development Company property located east of Martinez.
II. FINANCIAL IMPACT: There are no direct financial obligations to the County which
would result from the action.
III. REASONS FOR THE RECOMMENDATION:
1 . The subject property is in the unincorporated area of the County; BCDC is
reluctant to process the request of the City for the Bay Plan amendment (which
the City wants to be able to consider development and annexation of the property)
without the concurrence of the County.
2. The BCDC S.F. Bay Plan's Water-related Industry designation of the subject
property is obsolete.
3. The BCDC S. F. Bay Plan's Water-related Industry designation of other areas
along the County's northern shoreline is obsolete and excessive, can be used
to obstruct the appropriate use of the land, and places unnecessary hardships
on local governments.
4. The City of Martinez will reciprocally support the County's request to BCDC
for a review of the S. F. Bay Plan as it pertains to the County's northern
shoreline.
5. The City's request provides an opportunity for the City and the County to
cooperate on a matter of common interest.
IV. BACKGROUND:
The Board of Supervisors on December 3 , 1985 , referred the City's request to the
Community Development Department and the County Administrator.
The proposed action is recommended by the Director of Communi y Development. In
a May 1 , 1984 report to the Board of Supervisors , the Direct of Community Devel-
opment provided a detailed analysis of the originr of the Wa er-related Industry

category, its increasing inapplicability to a changing Bay Area economy, and its
use to leverage federal government permits. Earlier, in 1983 , the County
Director of Planning requested BCDC to review the S.F. Bay Plan as it pertains to
the County's northern shoreline (in the context of the time, this was a pre-
requisite step for an amendment) . This request should be .pursued as a formal
request for an amendment from the Board to the S.F. Bay Conservation and Devel-
opment Commission in -the future.
The proposed action is limited to the mutual advocacy of amendments to the S.F.
Bay Plan. On the County's part, it does not expressly or implicitly support any
proposed development action or change in local jurisdiction.
BCDC is presently obtaining consultant proposals for a Bay Area study focusing
on Water-related Industry. It is expected to be released in mid-1986. BCDC
probably will not act on S.F. Bay Plan amendments prior to completion of the study.
V. CONSEQUENCES OF NEGATIVE ACTION: Since there are other, although longer, courses
of action, the main consequence of a negative action would be to forgo the oppor-
tunity for the City and the County to support one another before a regional agency.

SUBJECT: Interim Report of the Contra Costa
County Grand Jury on the Acme Landfill
During the Board' s consideration of the request of the
City of Martinez that the Board support the application of the City
to the San Francisco Bay Conservation and Development Commission
(BCDC) for an amendment to BCDC' s San Francisco Bay Plan which would
eliminate the water-related industry designation on the CAZ Development
Company property located east of Martinez, William H. Ross, Foreman,
1985-1986 Contra Costa County Grand Jury, presented to the Board an
interim report urging the Board to exert every effort to extend the
life of the Acme Landfill for a two year period. He noted that the
current permit for Acme Fill issued by the U.S. Corps of Engineers
will expire on June 17 , 1987 . Mr. Ross advised that the Grand Jury
questions the propriety of BCDC' s San Francisco Bay Plan that
restricts the potential utilization of the Acme site to water-related
industries. He further advised that the Grand Jury is convinced
that extending the life of the Acme Landfill site would not impact
on water quality in the immediate area.
Board members expressed appreciation to Mr. Ross and indi-
cated that the Acme Landfill issue would be considered by the Board
at a later date.
There being no further discussion, IT IS BY THE BOARD
ORDERED that receipt of the Interim Report of the 1985-1986 Grand
Jury is ACKNOWLEDGED.
