SUBJECT: Sale, of Surplus Real Property
Colusa Avenue Air Space Easement
Project No. 0662-6U4332
Kensington Area
The Board of Supervisors of Contra Costa County RESOLVES THAT:
Contra Costa County acquired the real property on Colusa Avenue and Oak View
Avenue in Kensington, described in Exhibit "A" attached hereto, for road purposes.
It is DETERMINED that the air space above said property, from a point approximately
10 feet above the property, to a point approximately 42 feet above the property, as
more particularly described and delineated in the plan annexed hereto as Exhibit "B" ,
is surplus and not required for any County or public purposes and its estimated value
does not exceed $10,000.00.
This Board hereby APPROVES and AUTHORIZES the sale of said air space to Colusa
Circle Investors I, pursuant to Government Code Section 25526.5 and the Board Chair is
hereby AUTHORIZED to execute a Grant of Easement on behalf of the County in
consideration for the payment received in full in the amount of $1,500.00, the estimated
fair market value of the property.
The Real Property Division is DIRECTED to cause the Grant of Easement to be
delivered to the grantee.
The Board hereby FINDS that the project will not have a significant effect on
the environment, and DETERMINES that the project is exempt from the requirements
of the California Environmental Quality Act as a Class 12 Categorical, Exemption under
County Guidelines and Section 15312 of the State CEQA Guidelines, and DIRECTS the
Public Works Director to file a Notice of Exemption with the County Clerk. The project
has been found. to conform to the General Plan of the County of Contra Costa.
