HomeMy WebLinkAboutMINUTES - 03111986 - T.4 T.4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 11, 1986 , by the following vote: AYES: Supervisors Fanden, McPeak, Torlakson and Powers NOES: None ABSENT: Supervisor Schroder ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT : Application by D & M Development Company (applicant) and The Ryness Company (owners (2650-RZ) to rezone land and for approval of Final Development Plan 3059-85 This being the time for hearing on the recommendation of the Contra Costa County Planning Commission with respect to the application filed by D & M Development Company (applicant) and The Ryness Company (Owners) (2650-RZ) to rezone 4.12 acres of land from Single Family Residential District (R-6) to Planned Unit District (P-1) and application for approval of Final Development Plan 3059-85 for 88 residential units, located approximately 200 feet west of Bailey Road at the easterly extension of Mary Ann Lane to Bailey Road in the West Pittsburg Area; and Harvey Bragdon, Assistant Director of Community Development, described the property site and advised that a Negative Declaration of Environmental Significance was posted for this project. The Chairman declared the hearing open. No one appeared to speak on the matter. The Chairman declared the hearing closed. Supervisor Torlakson recommended that the applications be approved, subject to the conditions imposed by the Planning Commission, with the additional condition that the standard con- ditions imposed on other developments in West Pittsburg relating to fees for fire and flood control and drainage be imposed on this development. IT IS BY THE BOARD ORDERED that the recommendation of Supervisor Torlakson is APPROVED and that rezoning application 2650-RZ and Final Development Plan 3059-85 are APPROVED, subject 'to the revised conditions as set forth in Exhibit A attached hereto and by reference made a part hereof. IT IS FURTHER ORDERED that Ordinance Number 86-26 giving effect to the aforesaid rezoning is INTRODUCED, reading waived and March 25 , 1986 is set for adoption thereof. CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3059-85: 1. The permit is approved per plans submitted with the application dated received by the Community Development_ Department December 2, 1985, as modified by plans received February 6, 1986. 2. A 25 percent density bonus beyond that designated by the General Plan for a total of 88 residential units shall be permitted for this development subject to a commitment to have a minimum of not less than 6 of the residential units for persons 6D years of age or over or for persons of low and moderate income. The commit- ment shall be in the form of an agreement by the developer to be submitted for review and approval by the Zoning Administrator prior to issuance of a build- ing permit. In the event this commitment is not established, the number of residential units shall be reduced accordingly as it relates to the General Plan as determined by the Zoning Administrator. 3. Revised plans shall be submitted for review and approval by the Zoning Administrator prior to issuance of a building permit per alternate site plan B received February 6 , 1986, including a curveliner alignment to the westerly. driveway away from building #3. This will require some relocation of park 'ng proposed at the west boundary. 4. The guide for development and -ase provisions shall be the Multiple Residential District (M-17 ) . 5. Prior to issuance of a building permit, elevations and architectural design of buildings and structures, including carports, trash enclosures, etc. , shall be subject to final review and approval by the County Zoning Administrator. The roofs and exterior walls shall be free of such objects as air conditioning equipment, television aerials, etc. , or screened from view. Samples of materials and colors for exterior of units shall be submitted for review and approval. Exterior lights shall be deflected so that lights shine onto applicant's property and not toward adjacent properties. 6. Provision of a minimum of 125 square feet of private open space (i.e. , enclosed private patio) for each ground floor unit and a minimum of 70 square feet of -private open space (i.e. , enclosed deck area) for each second floor unit. The at-grade patio areas shall be screened and landscaped for privacy of the units. 7. Prior to the issuance of building permits, landscape and irrigation plans, prepared by a registered - EKH 7 .a 3059-85 Page 2 landscape architect, shall be submitted for review and approval by the County Zoning Administrator. A cost estimate or copy of contract for landscaping improve— ments shall be submitted with the plan. Landscaping and irrigation shall be installed prior to occupancy. A. The proposed trees on the site shall be a minimum 15 gallons in size. The proposed shrubs on the site shall be a minimum of 5 gallons in size. B. Consideration shall be given to contoured mounding for landscaping along Mary Ann Lane. 8. A sign directory displaying the numbers and location of all dwelling units in a diagram manner shall be posted at the vehicular entrance and main pedestrian entrance to the project in a location and of a size easily readable from entering vehicles. The directory shall include annunciations as may be required by the fire district. Project identification signs not to exceed ten ( 10) square feet in area off-site and at the driveway entrances of not more than eight (8 ) square feet. All units shall have house numbers or unit identification visible at all times which may require illumination. 9. A geotechnical report providing for foundation design and site grading shall be submitted to the Community Development Department (County Geologist) and Building Inspection Department prior to issuance of a building or grading permit. 10. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archaeologist who is certified by the Society of California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 11. Variances to the County Parking ordinance are approved to have less than the required dimension for parking spaces for compact cars for 20 percent of the required spaces. The width of sidewalks, where parking over- hangs are to be utilized, shall have a minimum clear-width of three feet. 12. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to 3059-85 Page 3 the requirements of Division 914 (Drainage) of the Subdivision Ordinance, unless exceptions are specifically granted. B. Removethe concrete ditch immediately west of this property and install Line AA of Drainage Area 48D, a 60-inch pipe, along the full length of the westerly property line of this property; or, an alternative acceptable to the Contra Costa County Flood Control District. C. Comply with the drainage fee requirements for Drainage Area 48D as adopted by the Board of Supervisors. D. Convey to the County, by Offer of Dedication, 56 feet of right-of-way as required for the proposed alignment of Mary Ann Lane through this property. E. Construct curb, 4-foot 6-inch sidewalk (width measured from curb face) , necessary longitudinal and transverse drainage, and approximately 36 feet of pavement widening. The face of curb shall be located 18 feet from the centerline of Mary Ann Lane. F. Construct the driveways serving the proposed units from Mary Ann Lane to at least a 20-foot pavement width to current County private road standards. G. Construct a paved turnaround at the end of the northerly driveway. H. Provide an additional driveway entrance from the south side of Mary 'Ann Lane to serve the units on the westerly side of this development. The connection between the two entrances shall be eliminated and landscaped. I. The applicant shall not permit his construction, traffic to use the portion of Mary Ann Lane located west of this property. He shall maintain a barricade at the westerly edge of his property at Mary Ann Lane until construction operations have been completed and then he shall be required to remove the barricade and patch the roadway as necessary. J. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for West Pittsburg as adopted by the Board of Supervisors. 3059-65 Page 4 R. Install all new utility distribution -services underground. L. Furnish proof to the Public Works Department, `Engineering Services Division, that legal accessj4r. to the property is available from the portion of,:,:', r: Mary Ann Lane located east of this property.. M. Prevent storm drainage, originating on the pro- perty and conveyed in a concentrated manner, from draining across the sidewalk driveways. N. Convey to the County, by Offer . of Dedication, a 13-foot wide drainage easement encompassing Line AA of Drainage Area, 48D plus additional easement area for conforms upstream and downstream, if necessary, as determined by the Contra Costa County Flood Control District. O. Furnish proof to the Public Works `Department, - Engineering Services Division, of the acquisition of all necessary right of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improve- ments. P. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Engineering Services Division, for review; pay the inspection . plan review and applicable lighting fees. These plans shall include any necessary traffic signage and striping plans for review by . the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Engineering Services Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public, Works Department. If final inspection is requested. prior to construction of irpprovements, the applicant shall execute a road improvement agreement. with Contra Costa County and post bonds required by the agreement to guarantee completion of the work. 13. , Comply with the requirements .of the Riverview Fire Protection District including the payment of the fire mitigation fee.
