HomeMy WebLinkAboutMINUTES - 03111986 - T.3 T.3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 11, 1986 , by the following vote: AYES: Supervisors Fanden, McPeak, Torlakson and Powers NOES: None ABSENT: Supervisor Schroder ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Assessment District 1984-2, East Bates Avenue, Concord area The Board on January 79 1986 fixed this time for hearing protests and to approve the amended Engineer' s Report for Assessment District 1984-2, East Bates Avenue, Concord area. Dave Jewett of the Engineering Services Divsion of the Public Works Department reviewed the efforts to date in the for- mation of the District, as well as the Area of Benefit which covers a portion of the area included in the assessment district. David Isakson, Isakson & Associates, Engineer of Work, described the improvements proposed for the District. The Chair announced that written protests had been received from Donald H. Gorman and Cal Gas Corporation and declared the public hearing open. The following property owners appeared and expressed their views: Carl Nelson, Attorney for Dennis E. Baca, landowner within the proposed district, protested the amount of the assessment assigned to Baca' s property, claiming that the assessment exceeded the benefit. Douglas Flett, Consultant for Dennis E. Baca, protested that the cost to Mr. Baca is inequitable and the benefits to Mr. Baca are not in correct proportion to the costs. Jim Schuricht, Engineer with Isakson & Associates, addressed the method of spread of assessments. Donald Gorman, property owner, advised that the streets were already constructed on Arnold Industrial Way andT•on Industrial Way which would provide him access, and that his parcel would not receive benefits equal to costs. Bud Lake, representing Bedford Properties and Mason Park property owners, advised that although the property owners he repre- sented had already paid for street improvements, drainage and cir- culation in Mason Industrial Park, he would urge that the assessment district go forward to take advantage of the favorable bids received for the improvements for the entire area as well as the favorable bond market at this time. No one else having desired to speak, the Chair declared the hearing closed. Board members discussed with staff and the Engineer of Work the various issues which were the subject of testimony received. Robert Brunsell, Bond Counsel, requested instructions with respect to the appropriate resolutions to be presented for the Board' s approval. The Board hereby DECLARES ITS INTENT to approve the for- mation of Assessment District 1984-2, East Bates Avenue, Concord area, and DIRECTS that the appropriate documents be prepared for the Board' s consideration and that the matter be placed in its agenda for March 18, 1985 . t hereby ceMy that this Is s true and correct copy art an action taken and anterad on the minutes of the Board of Supervisors on the date shown.
