A. Dehaesus, Director of the Community Development Depart- ment, advising that his Department will be contracting with the State Department of Health Services for the preparation of two environmental impact reports - one for Dow Chemical Company relative to their application for a hazardous waste incinerator, and the second for the Bay Air Quality Management District relative to five electric power system projects . Dehaesu SUBJECT: Dow Chemical Company and GWF Director of Commun De lopment Power Systems Company Environ- mental Impact Reports I have agreed to provide staff. management services to two regulatory agencies for the preparation of two Environmental Impact Reports for industrial projects which are of substantial concern to this County but which are not currently subject to County entitlements. The first project is Dow Chemical Company's proposed incinerator. Because the .incinerator is intended to dispose of hazardous wastes, the State's Department of Health Services will be the Lead Agency for California Environmental Quality Act .purposes. The second project is actually five individual small power plants, by the GWF Power Systems Company, which would be fueled by a petroleum refin- ing by-product (petroleum coke). Three would be located in the unincorporated area between the vicinity of Port Chicago and the area east of Antioch; one would be located in Antioch and another in Pittsburg. The Bay Area Air Quality Management District will be the Lead Agency. Applications for these projects have been filed with the respective regulatory agencies and they will be duly considered irrespective of our participation. In both cases, we were approached by the regulatory agencies, with the support of the projects' sponsors, to manage the preparation of the Environmental Impact Reports because of our experience in administering the development of complex EIRs and because of our local , general-purpose government grasp of multi-issue project impacts. .,, The alternative would be to have the special-purpose Lead Agencies oversee the develop- ment of the EIRs. .The Environmental Impact Reports would, of course, be. drafted by consultants who would be selected by us and the appropriate Lead Agency in each case. The costs of :the EIR process, including our charges, would be borne by the applicants. It is expected that the consultant contracts will be with the County. The Lead Agencies would contribute technical services during the EIRs' development, and would ultimately be responsible for certifying the products. Although our primary reason for agreeing to administer. these EIRs is to provide service and public protection similar to our oversight over County-regulated projects , we are also interested in the learning experience that comes .with managing highly technical inter-government projects. If you have any questions or reservations about our proceeding with these arrangements, please advise.
