RECOMMENDATION _ Find that an emergency exists and authorize the Director of General Services to proceed in the most expeditious manner, pursuant to. Section 20134 of the Public Contract Code, to construct new housing for approximately 60 inmates and to reconstruct a fire-damaged building at the Clayton Rehabilitation Center, and declare that the project, as an emergency, . is not subject to the provisions of the California Environmental Quality Act. II. FINANCIAL IMPACT Construction of new housing is funded and reconstruction of the fire-damaged building will be almost entirely funded from insurance proceeds, which will be available on completion of the reconstruction. III. BACKGROUND A. '•. The emergency is created by the overcrowding of inmates in the Martinez Detention Facility and the need to transfer greater numbers of inmates to Clayton. B. To protect the health and welfare of staff and inmates, actions are required immediately to decrease the overcrowding at the Martinez facil.ity.. The Sheriff-Coroner recommends that the Board declare an emergency, and that it proceed to immediately construct new buildings and reconstruct a fire-damaged building at Clayton to house approximately 60 inmates of non-violent misdemeanor/light felony classifications to relieve the overcrowding, thus leaving the secure beds at the Martinez Detention Facility for those requiring the greater security. Reconstruction of the fire-damaged laundry building is necessary to support the housing functions. C. The population in the Detention Facility has averaged 580.. in a structure designed to accommodated 386, including up to 130 in the intake area. designed for 52. Such overcrowding increases danger to the staff and inmates, 'and it is imperative to� initiate immediate action to decrease the population and reduce the potential for such dangers. D. The normal design, bid, construction process for this work is estimated to require ten to twelve months, The Sheriff-Coroner considers such delay unacceptable. It is possible to bypass the normal ' procedures for bidding the project and accomplish the project in approximately four to five months through the provisions of Section 20134 of. the Public Contract Code when the appropriate findings of an emergency are made by the Board. Therefore, IT IS ORDERED that the County Administrator is REQUESTED to report on April 22, 1986 at 10 :30 A.M. on the following: 1 . Status re-ort on the West County Detention Facility; 2 . Report on status of State jail bond funds; 3 • Alternatives for incarceration and rehabilitation of alcohol related offenders, including a report from the Alcoholism Advisory Board and CADSAC on alternative treatment methods; 4 . Status of the study on the staffing of the new deten- tion facility, a report from the Director of Personnel relative to staffing, and an update on the proposal to consolidate the Sheriff-Coroner and Marshal; 5 . Report on the establishment of a Citizens Advisory Committee for the design of the West County Detention Facility; 6 . An analysis of the inmate population relative to reasons for incarceration; 7 . Report on a proposed County owned and operated motel as an alternative form of incarceration for low risk inmates, such as drunk drivers, and a report from Health Services Mental Health Division and the Sheriff on the feasibility of such alternative incarceration; 8 . Report on status of legislation designed to reform drunk driving laws; and 9 .
