SUBJECT: EAST BATES AVENUE ASSESSMENT DISTRICT 1984-2

RECOMMENDATION
Relieve each owner of real property within the boundaries of the East Bates Avenue Assessment
District, as said boundaries were approved by the Contra Costa County Board of Supervisors
on July 16, 1985, from any further levy, assessment, or other liability whatsoever for
improvement of streets and roads as presently required by the Area of Benefit for Bates
Avenue/North Concord area.

REASONS FOR RECOMMENDATION/BACKGROUND
On April 9, 1985 the Board of Supervisors, by Resolution 85/170, adopted the Bates
Avenue/North Concord Area of Benefit requiring fees to be paid upon development of property
within the benefit area to be used for road improvements, including but not limited, to
portions of Bates Avenue, Port Chicago Highway and Industrial Way.
Certain property owners between the EBMUD aqueduct and Port Chicago Highway desired to
install their required road improvements through the assessment district process because
the improvements would be constructed up front rather than over a longer period of time
and costs would likely be less. Based on their petition the Board of Supervisors did on
July 16, 1985, by Resolution 85/421, approve the boundaries for the East Bates Avenue
Assessment District 1984-2.
Upon final approval of the assessment district and the ensuing assessment upon each property
owner's parcel through said assessment district's proceedings, it becomes reasonable and
equitable to relieve the parcels within -the assessment district from any further levy,
assessment, or other liability whatsoever for improvement of streets and roads as required
by the above referenced Area of Benefit.
In similar consideration the City of Concord, by their letter of July 27, 1984, expressed
agreement with relief from payment of their Offsite Street Improvement Project fees for
those properties installing their road and street improvements through the assessment
district process in the Bates Avenue/North Concord area.

The Board declined the regaest- of the Engineer of Work,(made on behalf of certain
property owners) to relieve the. -owners of real property within the District of any additional
fees for the life of the Assessment District.
