The Board of Supervisors of 6ontra Costa County, as the
Supervising Authority and Board o� Directors of the Brentwood
and Eastern Fire Protection Districts, resolves that:
1. This Board is the Superysing Authority and by this
Resolution is acting as the Board of Directors of both the
Eastern Fire Protection District and the Brentwood Fire Pro-
tection District, pursuant to Health and Safety Code 513884
and Board of Supervisors Resolution 80 /216.
2. This Board desires that the Eastern and Brentwood
Fire Protection Districts be combined in order to provide more
efficient and cost effective fire -protection services to the
territory of the two Districts -ty having one new district with
one board of fire commissioners, single management structure,
and one operational area througholt the .territory of the two
Districts.
3. Both Districts were formed and have been operating
under the Fire Protection District Law of 1961 (Health & Safety
Code S§13800 et seq. ) and are subject to Board of Supervisors
Resolution 80/216 . It is desired that the new consolidated
district also operate under the Fire Protection District Law of
1961 and Resolution 80/216.
4. This Resolution is a joint Resolution to apply to
the Local Agency Formation Commission of Contra Costa County,
pursuant to the District Reorganization Act (Gov. C. §§56000
et seq. ) , to initiate proceedings for a consolidation of the
Eastern and Brentwood Fire Protection Districts.
5. The exterior boundaries of the Districts proposed
to be consolidated are as shown in the attached Exhibits A(1)
and A(2) , which set forth the boundaries of the Eastern Fire
Protection District and the Brentwood Fire Protection District,
respectively.
6. It is proposed the name of the new fire protection disc.
trict formed upon the consolidation be the Eastern
Fire Protection District of Contra Costa County.
7. This Board proposes that a condition of the proposed
consolidation be that all property, other assets, rights,
obligations and personnel of the two Districts to be consolidated
become the property, other assets, rights, obligations and
personnel of the new consolidated District.
RESOLUT ION NO. 84/419
8. It is proposed that a condition of the proposed
consolidation be that the Board of Supervisors, as the
Supervising Authority, be the Boardof Directors of the
new consolidated District. This Bo rd hereby declares:-its
intent to appoint a Board of Fire Commissioners to manage
the affairs of the new consolidatedDistrict, pursuant to
Health and Safety Code §13884 and B and Resolution No. 80/216.
9 . Pursuant to Section 3 (a) o Article XIIIB of the
California Constitution, this Board hereby agrees and deter-
mines that, when the existence of t e present two Districts
ceases upon the effective date of t e consolidation, the
'appropriation, limits of the two Districts shall be combined
and be transferred to become the ap ropriation' . limit of the
new consolidated District.
10. A majority of the members of this Board, acting as a
majority of the members of the Supervising Authority and Board
of Directors of both of the Districts to be consolidated,
hereby adopt this Resolution of Application, declare their
intent to approve the proposed consolidation as conducting
authority of the proceedings for cgnsolidation, and respect-
fully request that the Local Agency Formation Commission
approve this proposal with the aforenoted conditions and in
accordance with Government Code §5 '261.1.
