HomeMy WebLinkAboutMINUTES - 07161985 - 1.82 TO: BOARD OF SUPERVISORS C011tra Phil Batchelor, FROM: County Administrator 4i) Costa DATE: July 2, 1985 County SUBJECT: Parking Ticket Processing Transferred from County to San Francisco Bay Area Rapid Transit District (BART) for Bay Municipal Court District SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION It is recommended that the Board of Supervisors approves the transfer of parking ticket processing to the San Francisco Bay Area Rapid Transit District (BART) for BART parking violations within the Bay Municipal Court District and authorizes the Chairwoman to execute said agreement. BACKGROUND On September 12, 1984 the Board of Supervisors approved the execution of contracts between the County and the Datacom Systems, Inc. , and between the County and all incorporated cities within the Bay Municipal Court for - Datacom to provide services to assist in the collection of parking citations within the Bay Municipal Court District. The approval of contracting for processing of parking tickets within the Bay Municipal Court District was to remedy the large backlog in unprocessed parking citations. The cities within the Bay Municipal Court District mutually agreed to retain Datacom Systems, Inc. to provide for an automated parking citation processing system to assist in the collection of parking citations. Each city respectively also agreed to fund the cost of the Datacom contract for collection of parking collections within each city. Instead of funding their respective costs of the Datacom contract for processing of BART parking citations within the Bay Municipal Court District and pursuant to Penal Code Section .1463( 3) , BART has requested the transfer of parking ticket processing from the County to BART. The Bay Municipal Court Judges have approved of this request. The parking ticket processing agreement between the County and BART provides that in the event a parking ticket issued by BART is contested in Bay Municipal Court, the County shall receive all bails, fines and forfeitures related to the contested ticket. In addition, BART agrees to pay the County treasurer $1.50 for each bail violation deposit collected which is not filed in court to the Jail Construction Fund. Payment is to be made on a monthly basis. FINANCIAL IMPACT The approval of this agreement has a slight financial impact. On a monthly average, BART issues 85 parking citations within the Bay Municipal Court District. The present distribution of parking ticket fines is BART 86% and the County 140. Therefore, on an average $7 parking ticket, the County would lose approximately $83 per month on the average. However, this impact would be reduced since the court would retain 1000 of all revenues from all contested fines. IMPACT OF ADVERSE ACTION If the Board does not approve the parking ticket processing transfer from the County to BART, BART parking citations issued within the Bay Municipal Court District will not be processed since the processing of all parking citations within the Bay Municipal Court District are under contract with Datacom and BART has elected to assume responsibility for processing of its parking tickets instead of funding its respective cost of the County contract.
