SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Support SB 159 (Presley) , which would authorize":thei-interception of wire .or oral
communications by certain law enforcement officers .,under,-specified judicial
authorization procedures.
BACKGROUND
Existing law generally prohibits electronic eavesdropping or recording of confidential
communications with certain exceptions for certain law enforcement officers. This
bill would authorize the interception of wire .or oral communications by certain law
enforcement officers under specified judicial authorization .procedures. The bill
would further require the Commission on Peace Officer Standards ;and Training to
establish a course of training and the .Attorney General to set standards for
certification of law enforcement officers to intercept private communications.
Further, SB 159 would provide that the general prohibition of electronic eavesdropping,
recording or tapping communications does not render inadmissable in a criminal
proceeding any communication intercepted by federal officers if validly authorized by
a federal court.
Senate Bill 159 would remove the current restrictions. in specified cases, while
continuing to protect the privacy rights of individuals. This bill would provide an
additional tool for law enforcement investigations, particularly where all other
investigative avenues have been exhausted.
