THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on June 4, 1985 , by the following vote:
AYES: Supervisors Powers , Schroder , McPeak , Torlakson and Fanden
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Appeal of A. V. Price from Board of Appeals approval of
LUP 2216-84 for Amerigas to operate an industrial gas and
welding supply distributorship in an existing building in
the Martinez area .
The Board on May 21 , 1985 deferred to this date and time
its decision on the appeal of AT. V. Price , et al , from the decision
of the Board of Appeals denying the appeal of approval of Land Use
Permit 2216-84 for Amerigas (applicant ) and W. R". Thomason, Inc .
(owner) to operate an industrial gas and welding supply distribu-
torship in an existing building in the Martinez area, the subject
property being located at 1000 Howe Road in the Martinez area .
Harvey Bragdon, Assistant Director of Community
Development , reported that a meeting by all parties concerned was
held May 31 , 1985 to review this matter , and that the access for
this property for Amerigas , Inc . , which has been in contention, has
been resolved; that the applicant/owner will relocate access from
across the easement to Howe Road at the east boundary of the pro-
perty; and that the existing driveway will be barricaded until the
legal status of the existing access is determined , but may be used
for a 60-day period to allow for driveway relocation; and noted that
the relocation will result in the removal of some large trees .
As recommended by Supervisor Fanden, IT IS BY THE BOARD
ORDERED that the appeal of A. V. Price is DENIED , the application
for Land Use Permit 2216-84 is APPROVED subject to the conditions
of approval , attached hereto as Exhibit A and by reference incor-
porated herein .

CONDITIONS OF APPROVAL FOR LAND USE PERMIT 2216-84:
I. The permit is approved per plans submitted with the application dated received by
the Planning Department December 14, 1984, and subject to the conditions listed
below.
2. The permit is approved for a portion of the property encompassing the front 400 feet,
extending not more than 150 feet to the rear of the existing building to be occupied
and extending not more than 50 feet easterly of the same building to within 50 feet
of the south or f ront property line.
3. Access for the property shall be relocated to the 50+ foot frontage at the east
boundary of the property. The relocated driveway access shall be installed within 60
days of the effective date of the permit, including provision for a barricade of the
existing driveway to prevent ingress-egress of the property. At such time as the
legal status of the existing driveway is determined, the applicant shall inform the
Zoning Administrator and shall either: provide proof of access to use the existing
driveway, or pursue diligently to remove the existing driveway and appurtenance and
to provide landscape treatment at that area.
4. All signs or modification of existing signs shall be submitted for review and approval
by the Zoning Administrator prior to installation.
5. There shall be no outside storage other than on the 30 foot concrete apron adjacent
to the building as designated on the plan.
6. All activity shall take place within the enclosed building.
7. Storage tanks shall not exceed the height of the roof of the existing building.
8. An eight foot high fence shall be installed as shown on the plan. The final design
shall be subject to the review and approval of the Zoning Administrator prior to
installation. The fence shall be installed within 90 days of the final approval of this
application.
The following statements are not conditions of approval. However, you should be aware
of them prior to requesting building permits or change of occupancy on the parcel of this
land use permit.
A. The Building Inspection Department requires plans and permits for change of
occupancy, and building permits for proposed improvements.
B. Comply with the requirements of the County Health Department. Sewer and water
service shall connect to public systems.
C. Comply with the requirements of the Contra Costa County Consolidated Fire
District, including gas storage requirements.
