HomeMy WebLinkAboutMINUTES - 06041985 - T.4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on June 4, 1985 by the following vote: AYES: Supervisors Fanden,Powers, Schroder, McPeak, and Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: In the Matter of Adopting Report, ) Determining Lack of Majority Protest, ) Establishing Area of Benefit, and Establishing Estimated Costs, Cost RESOLUTION NO. 85/302 Allocation, Fee Apportionment. ) Richmond/E1 Sobrante Area ) (ORD. C. Sec. 913-6.024, 913-6.026 The Board of Supervisors of Contra Costa County FINDS that: Government Code Section 66484 and Division 913, Title 9, of the Contra Costa County Code provide for assessing and collecting fees for bridge and/or major thoroughfare construction within a 4esignated Area of Benefit as a condition of approval of a final subdivision map or as a condition of issuing a building permit; and The Public Works Director and the Director of Planning, have completed a Development Program Report for the Richmond/El Sobrante Area of Benefit which was filed with the Clerk of the Board on April 30, 1985. Notice of the hearing was duly given in accordance with Section 913-6.014 of the Contra Costa County Ordinance Code; and ; A Negative Declaration pertaining to this project was published. No protests were received during the review period. The Board hereby CONCURS in the findings that the project will not have a significant effect on the environment and hereby DIRECTS the Director of Community Development to file a Notice of Determination with the County Clerk; and This Board hereby DETERMINES that a majority protest does not exist, inasmuch as a written protest has not been filed by the owners of more than one-half of the area of the property to be benefited by the improvement; and This Board hereby ADOPTS the Development Program Report of March 1985 pertaining to the Richmond/El Sobrante Area of Benefit, its boundaries, estimated cost of improvements, costs allocation, and method of fee apportionment with the amendment -that the interest accrued on the fees collected in this Area of Benefit shall continue to accumulate in the same account and shall be used to cover the cost of administration, design and construction of the fee area improve- ments; and The Board hereby Adopts the following fee schedule as recommended in the Development Program Report: Residential single-family, $1,749/unit; Residential multi-family, $1 ,224/unit; and Commercial , $1.25/square feet of gross floor area. The Board hereby RESOLVES that a. The Community Development Department and the Public Works Department are DIRECTED to work closely with the E1 Sobrante Traffic Advisory Committee on a continuing basis, in developing priorities, adding or deleting projects in the list attached as Appendix C to the Development Project Report, and periodically reviewing the fee schedule for the Board of Supervisors consideration. RESOLUTION 85/302 b. The Director of Community Development is DIRECTED to closely monitor future amendments to the currently adopted General Plan within this Area of Benefit and their impact on traffic and the Area of Benefit. C. The Director of Community Development and the Public Works Director are DIRECTED to continue working with the Building Industries Association on the method by which fees are collected with a subsequent recommendation to the Board of Supervisors. d. The Public Works Director is DIRECTED to request the City of Richmond, on behalf of the Board, to revise their current fee schedule, within this Area of Benefit boundary, so that the City's fees are consistent with the County's adopted Fee Schedule for the Richmond/E1 Sobrante Area of Benefit. NOW, THEREFORE, IT IS HEREBY RESOLVED that an Area of Benefit is hereby ESTABLISHED in the unincorporated area of the County of Contra Costa pursuant to Section 913-6.024 of the Contra Costa County Ordinance Code, the boundaries of which are described in the Development Program Report pertaining to the Richmond/El Sobrante Area of Benefit. IT IS FURTHER RESOLVED that the Clerk of this Board is DIRECTED to file a certified copy of this Resolution with the County Recorder as specified in Section 913-6.026 of the Contra Costh County Ordinance Code.
