HomeMy WebLinkAboutMINUTES - 06041985 - T.1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA DATE: June 4, 1985 MATTER OF RECORD SUBJECT: Decision on Remand in Bankhead Ranch vs. Board of Supervisors Subdivision 5808, Contra Costa Superior Court No. 231017 This being the time for the Board to deliberate on a decision on the subject matter, .and Supervisor Torlakson advised that he wished to have the Board review the matter in closed session with its attorney before making a decision; and Supervisor Shcroder advised that he had read the transcript recently as required by the Court and that he was ready to make a motion; and Supervisor Torlakson moved to defer the decision to the afternoon session. The motion was seconded by Supervisor McPeak and failed to carry by the following vote: Ayes: Supervisors McPeak and Torlakson Noes: Supervisors Powers, Schroder .and Fanden Supervisor Torlakson advised that he had reviewed the record after the matter had been entered into litigation and that he was of the opinion that the general plan spoke to this as being a leapfrogging issue and that staff at all levels has been urging the Board not to allow scattered leapfrogging development. He stressed concern that the school district would not be able to service the development and that the City of Brentwood had raised concerns about the general plan and question of service. He commented that the State had criticized the development of Discovery Bay as a leapfrog development, and urged the Board to reaffirm the general plan language as adopted in 1978 and stated that since the the mitigation cannot be adequately made, he moved that the Board request for its consideration on June 11 , 1985 a board order containing the exact order of findings in final form. The motion was seconded by Supervisor McPeak and failed by the following vote: Ayes: Supervisors McPeak and Torlakson Noes: Supervisors Powers, Schroder and Fanden Supervisor Schroder commented that, consistent with his previous action, he would move to declare intent to approve the application and deny the appeal . Board of Super- ) visors, Contra Costa ) Superior Court No. ) 231017 ) On June 4 , 1985 this Board deliberated on a decision on the subject matter, which has been remanded from the Superior Court for reconsideration. The Board hereby declares its intent to approve the subdivision application of Bankhead Ranch (deny the appeal of People for Open Space) and directs staff to prepare findings for its consideration and adoption on June 18, 1985.
