HomeMy WebLinkAboutMINUTES - 06041985 - 1.51 S/ TO: BOARD OF SUPERVISORS Contra FROM: Phil Batchelor, County Administrator Costa DATE: Coin May 29 , 1985 40 SUBJECT: Legislation: AB 1007 (Hayden) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position of support for AB 1007 by Assemblyman Tom Hayden which would authorize a city or county to require subdividers to pay a fee toward the provision of child care services as a condition to the approval of a tentative map or parcel map for industrial or commercial development. BACKGROUND: Existing law authorizes cities and counties to require subdividers to pay fees to defray the cost of various public services as a condition to the approval of a tentative subdivision map or parcel map. Assemblyman Hayden has introduced AB 1007 which would also authorize cities and counties to require the payment of a fee for child care services, subject to the following. requirements: • 1. The fee must be imposed by ordinance. 2. The ordinance has been in effect for 30 days prior to the filing of the tentative map or parcel map. 3 . The ordinance must include definite standards for determining the fee based on the child care needs generated by the proposed industrial or commercial development. 4. The fee can be used only for one or more of the following purposes: a. Construction, expansion, renovation, or repair of government-operated child care facilities. b. Purchase of equipment for government-operated child care facilities. Making low-interest or no-interest loans for the construction, expansion, renovation, or repair of private child care facilities. d. Making low-interest or no-interest loans for the purchase of equipment for private child care facilities. e. Direct subsidies for child care costs to families determined to be in need of such assistance. f. Start-up costs for the establishment of new child care programs. g. Providing child care referral services. h. Direct subsidies to private, nonprofit or govern- ment-operated child care facilities. 5. If the subdivider agrees to provide on-site child care services, or to provide child care through other alternatives, the value of the service must be credited against the amount of the fee that would otherwise be due. Since AB 1007 provides a mechanism for meeting additional child care needs generated by increasing industrial and commercial development, and leaves the option of implementing the fee with the Board of Supervisors (or City Council) , it appears consistent with the child care initiatives supported by the Board and deserves the Board' s support.
