ORDINANCE NO. 85-35
(Property Deveiopment TV-reement
for the Blackhawk Commercial Center)
The Contra Costa County Board of Supervisors ordains as
follows:
SECTION I. The Board hereby finds that the provisions of
that certain Development Agreement (Blackhawk Commercial
Center) between the County of Contra Costa and Behring
Educational Institute, Inc. and Blackhawk Corporation, a
copy of which is on file with the Clerk of the Board, and
which has been recommended for approval by the San Ramon
Valley Area Planning Commission by Resolution No. 27-1985
(SR) , are consistent with the General Plan as amended.
SECTION II. The Board hereby approves, pursuant to the
authorization provided in Sections 65864 et seq. , of the
Government Code of the State of California entering into
that certain Development Agreement (Blackhawk Commercial
Center) between the County of Contra Costa and Behring Edu-
cational Institute, Inc. and Blackhawk Corporation, subject
to review and approval of the Community Development Department
and County Counsel.
SECTION III. If any section, subsection, subdivision, para-
graph, sentence, clause or phrase of this ordinance is
for any reason held to be unconstitutional or invalid, such
a decision shall not affect the validity of the remaining
portions of this ordinance. The Board hereby declares that
it would have passed each section, subsection, subdivision,
paragraph, sentence, clause or phrase of this ordinance
irrespective of the unconstitutionality or invalidity of any
section, subsection, subdivision, paragraph, sentence, clause
or phrase.
SECTION IV. EFFECTIVE DATE. This ordinance becomes effective
30 days after passage, and within 15 days of passage shall be
published once with the names of supervisors voting for and
against it in the Contra Costa Times _, a newspaper published in
this County.

(Property Development Agreement
for the Amended Phase IV
Area of the Blackhawk Project)
The Contra Costa County_ Board of Supervisors ordains as
follows;
SECTION I. NEGATIVE DECLARATION.
A. Whereas, pursuant to the requirements of the California
Environmental Quality Act and State and County Guidelines, a
Negative Declaration has been prepared and duly noticed for the
Blackhawk Development Agreement (Amended Phase IV) between the
County of Contra Costa and Blackhawk Corporation, and whereas,
the San Ramon Valley Area Planning Commission, after a duly
noticed public hearing, recommended approval and certification of
the Negative Declaration by Resolution No. 28-1985 (SR) , and
whereas, this Board has considered said Negative Declaration
together with any comments received, the Board hereby makes the
following findings on the basis of the Initial Study, the
staff reports, the previously certified Environmental Impact
Reports referenced therein relevant to the project, the trans-
mittals submitted by the San Ramon Valley Planning Commission
and the comments received:
1. The previously approved Blackhawk Ranch project is a
large project consisting of 2, 237 units and 4, 800 acres;
2. The project involves the addition of 63 dwelling units
to the previously approved 2,237-unit Blackhawk Ranch development;
3. Ten Environmental Impact Reports containing environ-
mental documentation relevant to the project have previously
been certified;

4. There is no substantial evidence that the project will
have a significant effect on the environment;
5 . No substantial changes are proposed in the project
which would require major or important revisions of the
previously certified Environmental Impact Reports;
6 . No substantial changes have occurred with respect to the
circumstances under which the project is being undertaken which
would require major or important revisions in the previously
certified Environmental Impact Reports; and
7. No new information of substantial importance to the
project, which was not known and could not have been known at
the time the previous Environmental Impact Reports were cert-
ified as complete, has become available.
B. No subsequent Environmental Impact Report is required
for the project. The Negative Declaration for the Development
Agreement (Amended Phase IV) is hereby approved and certified.
SECTION II. DEVELOPMENT AGREEMENT.
A. The Board hereby finds that the provisions of that
certain Development Agreement (Amended Phase IV) between the
County of Contra Costa and Blackhawk Corporation, a copy of
which is on file with the Clerk of the Board, and which has
been recommended for approval by the San Ramon Valley Area
Planning Commission by Resolution No. 31-1985 (SR) , are
consistent with the General Plan.
B. The Board hereby approves, pursuant to the authorization
provided in Sections 65864 et sect. , of the Government Code of
the State of California, entering into that certain Development
Agreement (Amended Phase IV) between the County of Contra Costa
and Blackhawk Corporation, subject to review and approval of
the Community Development Department and County Counsel.
