HomeMy WebLinkAboutMINUTES - 06041985 - 1.11 (2) TO: BOARD OF SUPERVISORS Contra FROM: PHIL BATCHELOR � County Administrator Costa a DATE: May 20 , 1985 CourAy SUBJECT: UTILIZATION OF TEMPORARY COURT COMMISSIONERS RESOLUTION 85/303 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION- Adopt this resolution pursuant to Government Code Section 73362. 1 5 establishing the position of temporary court commissioner in each municipal court district, finding that there are sufficient funds in the budget of each court district to support such a position, and acknowledging that the judges of each court district have determined that the business of the court requires the use of such commissioners. FINANCIAL IMPACT: There would be some cost savings to the County when temporary court commissioners are used as substitutes for permanent court judicial officers instead of using outside judges. The four municipal courts expect to use temporary court commissioners for approximately 530 hours during fiscal year 1985-86. At an hourly rate of $25. 67 , these services would cost $13 ,600. Assigned judges would cost twice this amount. REASONS FOR RECOMMENDATION/BACKGROUND: The four Contra Costa County municipal courts wish to use temporary court commissioners as a means of minimizing the development of a large case backlog during the absence of permanent court judicial officers. Pursuant to the legislation, the judges of each municipal court have determined that the business of the court requires the occasional services of temporary court commissioners. The presiding judges have also requested that the Board of Supervisors adopt the resolution specified in Section 73362. 1 of the Government Code allowing the utilization of temporary court commissioners. This section shall remain in effect from January 1, 1985 until January 1, 1988 unless extended by statute. All four municipal court budgets include funds for this purpose. CONSEQUENCES OF NEGATIVE ACTION: If this resolution is not adopted, the municipal courts will have to resort to using assigned judges during absences of permanent judicial officers. This alternative will result in greater costs to the County.
