SUBJECT: AMENDMENT TO ANNUAL CONTRIBUTIONS CONTRACT
SECTION 8 HOUSING CERTIFICATE PROGRAM

I. RECOMMENDED ACTION:
Adopt Resolution No. 3457 authorizing execution by the Chairwoman and approving
Amendment to Part I of the Section 8 Existing Housing Program Annual Contributions
Contract No. SF-468 for the receipt of an additional 30 Section 8 Housing
Certificiates, as recommended by the Advisory Housing Commission.
II. FINANCIAL IMPACT:
Contract authority in the amount of $195,120 has been reserved for the Housing
Authority's fees and housing assistance payments. This is the maximum amount
approved by HUD for the number of units and unit size distribution specified below:

III. REASONS FOR RECOMMENDATION/BACKGROUND:
On January 22, 1985, the Board of Commissioners of the 'the Housing Authority of
the County of Contra Costa adopted Resolution No. 3448, approving submission of an
application to the U. S. Department of Housing and Urban Development for an additional
30 units of Section 8 Existing Housing. On April 29, 1985, notification was received
from the U. S. Department of Housing and Urban Development that the application for FY
85 Section 8 Existing Program had been approved and that the Annual Contributions
Contract was being prepared for forwarding.
At its May 13, 1985 meeting, the Advisory Housing Commission moved- to approve
an amendment to Annual Contributions Contract SF-468 adding Project No. CA39-E011-019
and refer all resolutions and amendments to the Board of Commissioners for adoption
and execution.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Should the Board of Commissioners elect to not authorize or execute this
Amenoinent to Annual Contributions Contract No. SF-468 for the Section 8 Housing
Certificate Program, the U. S. Department of Housing and Urban Development would
withdraw their reservation of 30 Section 8 Housing Certificates and the Housing
Authority would lose the use of $195,120.00 in rental assistance funds.

RESOLUTION APPROVING AMENDMENT NO. 2-C
TO SECTION 8 ANNUAL CONTRIBUTIONS CONTRACT SF-468
AND AUTHORIZING ITS EXECUTION
WHEREAS, the Housing Authority of the County of Contra Costa (herein called
the "PHA") entered into a Section 8 Annual Contributions Contract
on November 12, 1975, as amended, with the United States of
America (herein called the "Government"); and,
WHEREAS it is deemed advisable by the PHA and the Government to amend the
Section 8 Annual Contributions Contract in the particulars
indicated in such Amendment:
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Housing
Authority of the County of Contra Costa, as follows:
1. The Amendment to the Annual Contributions Contract is hereby
approved and accepted. The Chairwoman or Vice Chairman is
hereby authorized and directed to execute three counterparts
of the Amendment on behalf of the PHA, and the Secretary is
hereby authorized to impress and attest the official seal of
the PHA on each such counterpart and to forward such executed
counterparts, or any of them, to the Government together with
such other documents evidencing the approval and authorizing
the execution thereof as may be required by the Government.
2. This resolution shall take effect immediately.

ANNUAL CONTRIBUTIONS CONTRACT— PART I
for
HOUSING CERTIFICATE PROGRAM
1.1. DEFINITIONS.
A. ACC. Annual Contributions Contract.
B. Fiscal Year. the PAA Fiscal Year as specified in section 1.2.E of
this ACC.
C. HUD. U.S. Department of Housing and Urban Development.
D. Maximum Annual Contribution Commitment. The amount
specified in section 1.2.0 of this ACC.
E. PHA. Public Housing Agency.
F. Program Receipts. Amounts paid by HIID to the PHA under this ,
ACC for the PHA's Housing Certificate Program, and any other
amounts received by the PHA in connection with the program.
G. Program Expenditures. Amounts which may be charged against
Program Receipts. in accordance with the ACC and HUD
requirements.
1.2. EXISTING HOUSING CERTIFICATE PROGRAM.
A. �Pro'e�cts. The PHA's Section 8 Housing Certificate Program under

represents a funding increment for the program.

C. Maximum Annual Contribution Commitment. The Maximum
ual Contribution Commitment for all Program ftpenditures
shaII be = 13,222,596 for each PHA Fiscal Year.
(Insert amount equal to sum of the per project contract authority
amounts listed in Eddbit L) If the first fiscal year for a program
funding increment is more than 12 months (see section 2.2.D of this
ACC), the Maximum Annual Contribution Commitment for the
program for the PHA Fiscal Year may be adjusted as determined
by HUD by the addition of the pro rata amount applicable to the
period in excess of 12 months. HUD may reduce the Maximum
Annual Contribution Commitment by giving written notice of
reduction to the PHA in accordance with section 2.3 of this ACC.
D. Term of ACC. The term of this ACC ahxWkg konx

E. PHA Fiscal Year. The Fiscal Year for the PHA's Housing
Certificate gram shall be the 12-month period
ending March 31 of each calendar year. (Insert

administered by the PHA under an ACC with HUDJ
1 .3. ANNUAL CONTRIBUTION.
A. HUD shall pay the PHA an annual contribution for
the PHA's Housing Certificate Program in
accordance with HUD regulations and
requirements. The annual eontributioo shall be
in the amount approved by HUD for the PHA Fiscal
Year to cover the sum of:
1 . The amount of housing assistance payments
payable by the PHA.
• 2. The amount of PHA costs for program
administration.
The amount of the annual contribution by HUD may
be .redueed, as determined by HUD, by the amount •

of Program Receipts (such as interest income)
other than annual contributions .
B. Except as provided in section 1 .3.0 of this ACC,
the annual contribution payment by HUD for any
Fiscal Year shall not be more than the Maximum
Annual Contribution Commitment.
C. An ACC reserve account may be established and
maintained by HUD, in an amount as determined by
HUD consistent with its responsibilities under
section 8(c) (6) of the Act . The AOC reserve
account may be used by HUD for payment of any
portion of the annual contribution payment
approved by HUD for the PHA's Housing Certificate
Program for a Fiscal Year which exceeds the
Maximum Annual Contribution Commitment for the
program.
1 .4. ACC.
A. This ACC consists of this ACC Part I ( including
Exhibit I) and the form ACC Part 11 prescribed by
HUD for the Housing Certificate Program and
Housing Voucher Program, designated as form HUD
52520 E, and dated December 1984. These
documents constitute the whole ACC for the PHA's
Housing Certificate Program.

B. This ACC supersedes any previous ACCs for the
-FHA's Housing Certificate Program. Matters
-relating to operation of the PHA's Housing
Certificate Program under a previous AOC shall be :
governed by this AOC.
