HomeMy WebLinkAboutMINUTES - 06251985 - 1.7 (2) 1_07 0 TO: BOARD OF SUPERVISORS FROM: PHIL BATCHELOR Contra a County Administrator Costa DATE: June 18, 1985 County .SUBJECT: CONTRACT WITH CONTRA COSTA COUNTY BAR ASSOCIATION FOR CONFLICT „`r DEFENSE SERVICES SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: Approve the contract with the Contra Costa County Bar Association in the amount of $163,000 for the period July 1, 1985 through August 31, 1985 for conflict defense services and authorize the Chair to execute a contract on behalf of the County. FINANCIAL IMPACT: Funds are included in the Proposed Budget for 1985/86. The recommended action has no additional financial impact. REASONS FOR RECOMMENDATION/BACKGROUND: In 1983, your Board directed the County Administrator to organize a Task Force to explore new options for Contra Costa County to use in handling indigent defense cases involving Public Defender conflicts of interest. The Board's aim was to control the escalating costs of court appointed counsel in these conflict cases. After careful study, the Task Force on Court Appointed Counsel recommended that the County pursue a contract with the Contra Costa County Bar Association for legal representation of conflict defense services. Your Board adopted this recommendation and executed a contract with the Bar Association for these services in 1984/85. That contract expires June 30, 1985. A two-month contract is recommended to continue the Bar Association's conflict defense into fiscal year 1985/86. The body of the contract differs only in minor details from the 1984/85 contract approved by your Board. The fee schedule for this two-month contract is the same as used in 1984/85. A two-month contract is recommended while the County Adminis- trator's Office negotiates with the Bar Association concerning the impact of a new fee schedule proposed by the Association. CONSEQUENCES OF NEGATIVE ACTION: If the recommended contract is not approved, appointment and payment of private attorneys .for conflict cases will revert to the method used before the 1984/85 contract and become a responsibility of the judges again.
