MICHAEL WALFORD, PUBLIC WORKS DIRECTOR ' County "1 DATE: June 25; 1985 SUBJECT: NOTICE OF CONDITIONS, COVENANTS, AND RESTRICTIONS FOR PUBLIC ACCESS PARCEL - SANITATION DISTRICT NO. 5 Specific Requests or Recommendations & Background & Justification RECOMMENDED ACTION 1. The Board of 'Supervisors, as Governing Board of Contra Costa County Sanitation District No. 5, authorize the Chairwoman to execute the Notice of Conditions, Covenants, and Restric- tions, a portion of SBE 872-7-26B, Parcel 11; and 872-7-26, Parcel 4. 2. The Public Works Department be directed to have the Notice of Conditions, Covenants, and Restrictions recorded in the Office of the County Recorder. FINANCIAL IMPACT None REASONS FOR RECOMMENDATION/BACKGROUND On August 19, 1982, the San Francisco Bay Conservation and Development Commission (BCDC) approved a permit to allow the construction of a wastewater treatment plant in Contra Costa County Sanitation District No. 5 (Port Costa). One of the conditions of the permit was the acquisition and dedication as a shoreline public access parcel. All property, including the public access parcel, was acquired by a permanent easement from the Southern Pacific Transportation Company. Copies of the deeds between the District and Southern Pacific were sent to BCDC for their review and approval. On September 28, 1983, BCDC notified the District that an additional instrument was required to further insure that the public access parcel will be dedicated to public use for as long as the District deed with Southern Pacific is in effect. BCDC suggested that a Notice of Conditions, Covenants, and Restrictions be executed between BCDC and the District. After a long negotiation!, and review period, which included Southern Pacific, BCDC, and County staff, the attached Notice of Conditions, Covenants, and Restrictions were approved by all parties. The Notice of Conditions, Covenants, and Restrictions has been reviewed by County Counsel. Execution of this' document completes the requirements for the BCDC permit for the wastewater treatment plant. The wastewater treatment plant was completed in September 1984, and is now in full operation.
