SUBJECT: Contract for preparation of a+Relocation Planforthe
Pleasant Hill BART Redevelopment Project.
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Approve and authorize the executive Director to execute an
agreement between the Redevelopment Agency and Ehrhardt Real
Estate Services for preparation of a Relocation Plan and other
relocation consulting services in an amount not to exceed
$15,000.
FINANCIAL IMPACT
The contract includes $12,300 for preparation of a Relocation
Plan and $2,700 for additional relocation services to be paid
from budgeted Agency funds. Some portion of these costs in
connection with specific relocations will be reimbursed to the
Agency by the developers. The amount of reimbursement is
indeterminate at this time.
REASONS FOR RECOMMENDATION/BACKGROUND
State Relocation Guidelines (Section 6038) required that a
Relocation Plan be prepared prior to proceeding with a project
that will result in displacement of housing' and businesses.
Pursuant to execution and implementation of proposed agreements
with developers in the Pleasant Hill BART Project Area there will
be displacement of 30 or more households eligible for relocation
assistance. Therefore, a Relocation Plan is required, and indeed
would be beneficial, in assuring that displaced households
receive the assistance they are due.
The contractor, Ehrhardt Real Estate Services, has provided
similar services for the County and Agency. Their work has been
satisfactory and they have the qualifications to perform the
services required by this contract. Ehrhardt previously
completed replacement housing and preliminary relocation surveys
in the Pleasant Hill BART Project.

SHORT FORM CONTRACT SERVICE
1. Contract Identification: Number
Relocation services in connection with the Pleasant Hill
BART Revelopment Project.
2 Parties: The Contra Costa County Redevelopment Agency
(the "Agency" ) , a body corporate and politic, and the
following named Contractor mutually agree and promise as
follows : ='

3 . Term: The effective date of this Contract is June 1, 1985,
and it terminates December 31, 1985, unless sooner
terminated as provided herein.
4. Termination. This Contract may be terminated by the Agency,
at its sole discretion, upon five-days advance written
notice thereof to the Contractor, or cancelled immediately
by written mutual. consent.

5. _Payment Limit. Agency' s total payments to Contractor under
this contract shall not exceed $15,000.
6. Agency' s Obligations. In consideration of Contractor' s
provision of services as described below, and subject to the
payment limit expressed herein, Agency shall pay Contractor
upon submission of a properly documented demand for payment
in the manner and form prescribed by Agency (Demand
Form D15) and upon approval of such demand by the Agency' s
Executive Director or his designee, as follows:
A. $10 , 500 for preparation of the Relocation Plan.
B. $ 1,800 for preparation of the Last Resort Housing Plan.
C. 41 hours of additional consultation at $65 per hour.
7. Contractor' s Obligations. Contractor shall provide the
following described services: per scope of work attached
hereto and incorporated herein.
8. Independent Contractor Status. This Contract is by and
between two independent contractors and is not intended to
and shall not be construed to create the relationship of
agent, servant, employee, partnership, joint venture,
or association.
9. Indemnification. Contractor shall defend, save harmless
and indemnify the Agency and its officers, agents and
employees from all liabilities and cliams for damages for
death, sickness or injury to persons or property, including
without limitation, all consequential damages, from any
cause whatsoever arising from or connected with the
operations or the services of the Contractor herunder,
resulting from the conduct, negligent or otherwise, of
the Contractor, its agents or employees.
10. Legal Authority. This Contract is entered into under the
provisions of Health and Safety Code Section 33125.
11 . Signatures. These signatures attest the parties' agreement
hereto.
